Purpose: The purpose of this work is to describe the nature of copyright can be applied in the context of cosplay activities and the challenges and obstacles faced by cosplayers in understanding and respecting copyright and brands in cosplay practice. Theoretical framework: Cosplay is an adaptation of creation, where the process of making cosplay costumes and accessories is carried out by changing the form of a sketch design/drawing of a costume or character design into a costume that can be used in real life. Copyright regulates provisions regarding legal protection for adaptations of works. Design/methodology/data analysis: The research methods used in this article are analytical and descriptive approaches. Data is collected through literature studies that include articles, journals, books, and other reliable sources. The data is then analysed and interpreted to identify challenges and barriers in understanding copyright in cosplay, as well as to conduct legal comparisons between different countries. Findings: Copyright protection is important in cosplay, with the potential for infringement if using character and brand works without permission. Cosplayers need to understand boundaries and communicate with the original owner to avoid violations. Cosplayers face challenges in understanding and respecting copyright and brands, including limited legal understanding and difficulty obtaining official permission. It is important for them to continue to deepen understanding and communicate with the original owner to avoid violations. Originality/value: This article focuses on character copyright protection in Cosplay, where it is necessary to clearly regulate whether cosplay violates copyright or does not violate copyright. Practical implications: Cosplay creators need to understand well the copyright regulations in a country, to know whether their actions violate copyright or not. Law enforcers need to understand and re-examine whether the act of cosplay violates the economic rights of the creator or not.

Hukum tanah nasional ( UUPA) tidak diatur bahwa hak guna usaha perusahaan dapat diusahakan diatas tanah hak pengelolaan dan tanah ulayat masyarakat hukum adat menjadi hak pengelolaan. Penelitian ini bertujuan untuk mengetahui dan menganalisis proses perjanjian pengusahaan tanah ulayat oleh perusahaan dan status tanah ulayat apabila perjanjian antara perusahaan dan masyarakat hukum adat terkait pengusahaan tanah ulayat telah berakhir. Penelitian ini menggunakan metode yuridis normatif, yaitu sumber data yang digunakan adalah data sekunder, diperoleh dari dokumen resmi, buku-buku, laporan tertulis lainnya, serta kamus dan ensiklopedia. Hasil penelitian proses usaha tanah diawali dengan perjanjian pemanfaatan tanah, tanah digunakan usaha perusahaan kemudian pengajuan permohonan ke Kantor Pertanahan setempat terkait Hak Pengelolaan oleh Masyarakat hukum adat dan Hak Guna Usaha oleh Perusahaan, sedangkan status tanah ulayat setelah jangka waktu perjanjian berakhir maka tanah hak pengelolaan yang diatasnya berlaku hak guna usaha perusahaan akan kembali menjadi tanah ulayat masyarakat hukum adat.

Tulisan ini bertujuan untuk menganalisis hak-hak konsumen dalam transaksi e-commerce, dan analisis hukum terkait penyelesaian sengketa dalam transaksi melalui e-commerce. Masalah difokuskan analisis pada hak-hak konsumen dan penyelesaian sengketa di luar pengadilan dalam sengketa perdagangan e-commerce. Untuk menganalisis permasalahan yang ada maka digunakan metode yuridis normatif yang mendasarkan pada norma-norma positif. Data-data dikumpulkan melalui studi kepustakaan dan dianalisis secara kualitatif. Kajian ini menyimpulkan bahwa electronic commerce atau yang disebut dengan e-commerce merupakan pasar tanpa batas yang dapat melampaui semua batas, seperti perbedaan waktu, perbedaan bahasa, perbedaan mata uang dan perbedaan peraturan. Masyarakat umumnya melakukan e-commerce karena banyaknya kemudahan yang ada di dalamnya, banyaknya pengguna juga semakin bervariasi. Negara telah mengatur mengenai perlindungan dalam transaksi e-commerce yaitu melalui Undang-undang Perlindungan Konsumen. Transaksi E-Commerce tanpa batas yang melampaui perbedaan regional jika terjadi dapat diselesaikan melalui Alternatif Penyelesaian Sengketa, yang di dalamnya terdapat berbagai bentuk seperti negosiasi, mediasi, konsiliasi, konsultasi, expert judgement, dan arbitrase. Praktik penyelesaian sengketa pada e-commerce dengan Alternatif penyelesaian sengketa menjadi pilihan tepat bagi para pelaku usaha dan konsumen yang membutuhkan penyelesaian yang cepat, murah, dan bersifat rahasia. Penyelesaian sengketa menggunakan alternatif penyelesaian sengketa memiliki keuntungan bagi kedua belah pihak yang bersengketa dengan didasari itikad baik kedua belah pihak.



Legal Consequences of Transferring Children’s Assets in Trusteeship Without Involving The Heritage Treasure Hall As Trustee

The purposes of this research is to analyze legal ptotection for children in guardianship, which there is a transfer of assets in guardianship without involving Heritage Treasure Hall as supervisory trustees. The article will use a doctrinal research method to analyze the legal aspects of children guardianship. Guardianship is oversight of minors who are not under the authority of their parents so their legal position needs to be represented by a guardian. In a trusteeship, the guardian has rights and obligations over the life of the child under his guardianship and is responsible for the property of the child. In carrying out its role, under Article 366 of the Civil Code, the guardian is supervised by a supervisory guardian, in this case, the Heritage Treasure Hall. However, the Heritage Treasure Hall is less involved in trusteeship activities, especially in the transfer of children’s assets in trust. Actions that do not involve the Heritage Treasure Hall will result in the termination of a guardian and all actions that have been taken may be cancelled.



Online dispute resolution: Does the system actually enhance the mediation framework?

Online mediation as a form of Online Dispute Resolution has become a global movement that is increasingly actively developed as a form of mediation flexibility which is believed to increase the effectiveness and efficiency of alternative dispute resolution through the use of technology as the purpose of the Online Dispute Resolution itself. This paper aims to i) identify the obstacles and challenges faced in implementing online mediation; and ii) analyze the effect of the Online Dispute Resolution system on enhancing the mediation framework. This paper uses a normative juridical method, with the results showing that i) because it is a system that is still being developed, the implementation of online mediation still faces various obstacles and challenges; and ii) the obstacles and challenges faced in implementing online mediation are barriers to enhancing the mediation framework. Instead of providing an increase in the process, the use of technology in mediation actually seems to present new problems, such as causing legal uncertainty, security and confidentiality are not guaranteed, difficulties in building relationships, and so on. Online mediation is still in the development stage without clear rules and boundaries. If these barriers can be overcome, then the Online Dispute Resolution system can achieve its goals and enhance the mediation framework, so that an alternative dispute settlement will be created through mediation that is more effective and efficient.

Litigasi perubahan iklim di Indonesia mengalami perkembangan cukup pesat, mengingat bertambahnya jumlah perkara dan putusan terkait gugatan litigasi perubahan iklim. Melihat praktik litigasi perubahan iklim, setelah dilakukan pemilahan serta identifikasi isu/motivasi, maka litigasi perubahan iklim di Indonesia, meliputi jenis litigasi dengan motivasi perubahan iklim bukan sebagai isu utama dan litigasi bukan motivasi perubahan iklim, namun berimplikasi pada mitigasi dan adaptasi perubahan iklim. Tujuan tulisan ini yaitu untuk menganalisis tindakan perbuatan melawan hukum yang dilakukan oleh pelaku pelanggaran hukum dengan mendasarkan kepada doktrin kesengajaan, kelalaian, pertanggungjawaban mutlak, dan tindakan faktual. Riset ini dapat memberikan pilihan advokasi kebijakan perubahan iklim melalui litigasi di pengadilan bagi para pencari keadilan.

The digital era is something that cannot be avoided in Indonesia and even throughout the world. Various Activities change from analog to digital. Digitization activities are carried out by a notary, one of the professionals, who digitize documents for needs, and orders of laws and regulations. This article aims to analyze the urgency of document digitization carried out by Notaries, and its implications for the performance of Notaries in the current era of technological transformation. In addition, this article will also discuss the obstacles and challenges for notaries in digitizing documents. This article is the result of research conducted using the socio-legal method. Socio-legal studies carry out textual studies of articles in legislation and policies that can be critically analyzed and explained their meanings and implications for legal subjects. Several laws and regulations require notaries to digitize, especially document digitization. The process of digitizing documents carried out by a Notary is still in the stage of digitizing printed documents and placing them in a file for uploading needs on the web or certain systems. This process has its obstacles and challenges for Notaries and employees who work at Notaries.
