Research background: Public procurement for innovation has increasingly been the subject of EU policy makers. A lot of changes in the European directives and Polish law have been observed that facilitate the process required for the public procurement of innovation. Purpose: The purpose of the paper is an attempt to study a functioning public procurement system as a sourcing mechanism for innovative products and services in Poland. Research Methodology : Review of the existing legislation concerning public procurement especially the Public Procurement Law in Poland after its amendment of 2016 and analysis of the results of a survey conducted among contracting entities and contractors of public procurement. Results: The empirical study suggests that there is a deficit of knowledge of both contracting entities and contractors, concerning awareness and application of legal provisions facilitating procuring innovative products. The existing scale of innovative solutions’ application by contracting entities is very low, resulting from a lack of needs or due to the business profile, which does not contribute to increasing the demand for innovative products. Novelty: There is a lack of similar investigations in the Polish and European literature. It is worth stressing that public procurement viewed as a special case of innovation which is distinct from the procurement of a regular market. The empirical results are based on a study conducted in 2018 by the Public Procurement Office in Poland.

The aim of the paper is identification of variables appearing in public procurement and public-private partnership (PPP) procedures. The literature insufficiently defines the problem of innovation in the public procurement and PPP procedures. Identification and measurement, and then the use of appropriate measurable and immeasurable variables allow to create the transparent and understandable procedures for all market participants. A correctly adopted methodology allows to reduce the risk of failure to complete the task already at its initial stage. The paper attempts to distinguish individual elements of the procedure in public procurement and PPP procedures, taking into account the possibility of identifying and measuring variables describing different aspects of agreements between procurers and contractors (eg. The subject of the contract, criteria for evaluation of offers, etc.). The innovativeness of performed public procurement and contracts concluded within the framework of public-private partnership has been described using comparative analysis of individual proceedings. Ustawę o zamówieniach publicznych. Od tego czasu w tym ustawodawstwie pojawiło się wiele zmian mających na celu poprawienie funkcjonowania systemu zamówień publicznych oraz doprowadzenie do zgodności tego systemu z dyrektywami Unii Europejskiej. W 2004 r. Polska, stając się członkiem UE, opublikowała ustawę Prawo zamówień publicznych, która po szeregu nowelizacji obowiązuje do chwili obecnej. W nowych dyrektywach unijnych, uwzględnionych również w polskim Prawie zamówień publicznych, akcent położono na uwarunkowania sprzyjające innowacyjności poprzez zamówienia publiczne. Celem niniejszego artykułu jest próba oceny tych uwarunkowań prawnych w odniesieniu do innowacyjnych zamówień publicznych. Ponadto opisano rezultaty badania empirycznego, polegającego na przeprowadzeniu wywiadów ankietowych wśród podmiotów zamawiających w Polsce na temat oceny potencjalnego wpływu zamówień publicznych na poprawę innowacyjności ofert. </span

W pracy podjęto próbę oceny roli wielokryteriowego modelu oceny ofert jako aktywnego instrumentu oddziaływania zamawiających na przedmiot zamówień publicznych. Zwrócono uwagę na nowelizację przepisów Prawa zamówień publicznych oraz konsekwencje z niej wynikające dla uczestników procedury zamówień publicznych. Analizę przeprowadzono na przykładzie usług ochrony osób i mienia. Przedstawiono stan zamówień publicznych w branży przed i po nowelizacji, a więc de facto wpływ nowelizacji Pzp na zmianę struktury realizowanych przetargów publicznych. W opracowaniu wykorzystano fachową literaturę prawną, sprawozdania UZP, raporty innych autorów oraz własne badania oparte na danych z pierwszego kwartału 2015 r., pochodzące z Biuletynu Zamówień Publicznych.
