Theis Klauberg’s scientific contributions

This chapter discusses suretyship contracts in Latvian banking practice. Topics covered include commercial suretyships and consumer suretyships, suretyships and indebtedness of individuals and families, unfair suretyships of non-professional guarantors, laws for surety protection, impact on the guarantor's position of changes in the debtor-creditor relationship, the most effective means of protection for non-professional sureties, and proposals to improve the protection of non-professional sureties.

I. Banksystem. Die allgemeine Struktur des Bankensystems ist gesetzlich durch das Bankrechtsgesetz (Nationales Gesetzesregister, 26.07.2006, N 113, 2/1243, nachfolgend: BG) geregelt. Gemäß Art. 6 BG besteht das Bankensystem aus der Nationalbank der Republik Belarus (www.nbrb.by) sowie Geschäftsbanken und Nichtbankkredit- und Finanzorganisationen. Als Zentralbank ist die Nationalbank eine staatliche Institution mit der Aufgabe, das Kreditsystem und den Geldumlauf zu steuern sowie den Zahlungsablauf zu regeln. Sie hat das Exklusivrecht der Geldemission (Art. 7 BG) und den Auftrag die Richtlinien der Finanzpolitik zu bestimmen (Art. 26 BG). Darüber hinaus ist sie Kontrollinstitution für sämtliche Bankgeschäfte (Art. 34 BG).
