Freedom of panorama, an exception to copyright law, is the legal right, in some countries, to publish pictures of artworks which are in public space. A controversy emerged at the time of the discussions towards the revision of the 2001 European Copyright Directive, opposing free knowledge communities as advocates of the public domain, and authors’ collecting societies aiming at preserving their constituents’ income. The article decrypts the legal framework and political implications of a topic which has been polarising copyright reform lobbyists, and analyses its development within the public debate since the XIXth century. Articulating legal analysis with text mining, this article aims at contributing to the policy debate.

Inspired by a specific philosophy, the “free” movement first emerged in the software and academic research fields and has since enjoyed considerable economic success. In the field of culture, initiatives are born in a specific intellectual context, which we begin by briefly reviewing, and the revolutionary ambitions of pioneers have evolved with the development of Creative Commons licenses. These licenses, which originally were but one form of free license among many, have gradually gained a monopolistic position for numerous reasons, and in their 15 years of existence, their use has greatly increased. We present in this chapter an initial assessment of the use of these licenses based on the scattered statistical data that is available. This appraisal provides an overview in terms of the works available, the varied practices of creators and consumers of works, and the variety of economic models.

La propriété intellectuelle joue un rôle dans le processus de légitimation et dans les intérêts économiques des industries culturelles musicales. Depuis plus de deux siècles, la protection juridique a contribué à renforcer l’autonomie de la création musicale en hypostasiant l’individualité des compositeurs dans la formule légale du « droit d’auteur ». En revenant, avec Adorno, sur les conditions socio-économiques et historiques de la construction symbolique du « droit d’auteur », le but de cet article est de mettre au jour la part construite du droit, en vue d’intérêts proprement industriels, et de se demander si sa transformation progressive face aux mutations contemporaines, par l’industrie elle-même, peut encore préserver ce pour quoi les artistes eux-mêmes y trouvaient leur intérêt : la reconnaissance sociale du musicien comme auteur et de sa création comme œuvre.

The first pillar of Wikipedia stresses that « Wikipedia is not a democracy ». The wikipedian communities tend to view democracy and polling as the alter ego (if not the nemesis) of negociation and consensual thought. This article questions the validity and the motives of such a specific conception. Using the conceptual framework of Arend Lijphart, it describes the emergence of a joint-system, which includes elements of majoritarian democracy into the general setting of a consensual democracy. The unconditional rejection of democratic interpretation seems to have its own social use : it allows a pragmatic acclimation of pre-existent procedures in the static political system.

Le premier principe fondateur de Wikipédia souligne que « Wikipédia n’est pas une démocratie ». Les communautés wikipédiennes tendent à ériger la négociation en contre-modèle de la démocratie et de la voie des urnes. Cet article s’interroge sur la validité et les motifs de cette conception spécifique. S’appuyant sur le cadre d’analyse élaboré par Arend Lijphart, il met en évidence l’émergence d’un modèle de gouvernance mixte, intégrant des éléments de démocratie majoritaire dans le cadre d’une démocratie consensuelle. Le rejet de l’interprétation démocratique a une utilité sociale : il permet d’appréhender les procédures politiques traditionnelles sur un mode exclusivement pragmatique.
