Factores de riesgo derivados del cambio climático como la subida del nivel del mar, el aumento de temperaturas y la escasez de agua amenazan a la población costera e insular en España. A su vez, el progresivo empobrecimiento de la población en ciertas partes del territorio, como consecuencia del cambio climático, especialmente en las áreas rurales, ha propiciado el “vaciamiento” de estas zonas hacia las ciudades, también vulnerables a los riesgos climáticos. Estos movimientos, quizás imperceptibles, hacen reflexionar, ante un futuro no muy lejano, sobre los efectos del cambio climático en la decisión de migrar. Este artículo reflexiona sobre cómo los impactos climáticos tienen una incidencia en los desplazamientos internos de población en España, contribuyendo a un análisis comprensivo, hasta ahora ausente. La metodología empleada es la inductiva y la deductiva, a partir del examen de los estudios científicos y estadísticos, que evidencian la realidad de los desplazamientos climáticos en España, así como del marco jurídico-político aplicable. Ante la limitada respuesta a estos movimientos de población, urge establecer estrategias de adaptación y resiliencia que aborden estos desplazamientos, con un replanteamiento no solo de las políticas climáticas, sino también de las socioeconómicas para una recuperación de los territorios rurales españoles.

Hace más de una década, Bolivia llamó la atención internacional cuando aprobó el primer conjunto de leyes nacionales del mundo que reconocen los derechos de la Naturaleza o Madre Tierra. Este innovador avance normativo afronta la orientación jurídica antropocéntrica dominante y a partir del reconocimiento del valor intrínseco de la Naturaleza pretende proporcionar un marco jurídico sólido para salvaguardarla y para superar las prácticas ecológicamente destructivas que la amenazan y vulneran sus derechos. Los esfuerzos de Bolivia por proteger legalmente los derechos de la Madre Tierra constituyen un hito importante tanto a nivel nacional como internacional. Sin embargo, este es sólo el primer paso para lograr un cambio más profundo y transformador en el país. De hecho, desde la aprobación de este nuevo marco normativo de enfoque ecocéntrico, su implementación ha estado lleno de obstáculos y desafíos. Mientras tanto, en el país se han promovido desarrollos legales y políticos ambientalmente destructivos, por ejemplo para permitir la expansión del agronegocio y de la frontera agrícola, así como la exploración y explotación de gas y petróleo dentro de territorios indígenas y áreas naturales protegidas. En general, los últimos diez años han demostrado, una y otra vez, que los intereses económicos y políticos tienen prioridad sobre la Madre Tierra y sobre el cumplimiento y realización de sus derechos. El presente trabajo analiza críticamente el marco normativo de Bolivia sobre los derechos de la Naturaleza. Más concretamente, examina hasta qué punto dicho marco ha sido aplicado en la práctica e identifica los principales obstáculos y desafíos que dificultan su aplicación efectiva.


Litigating Climate Change in Bolivian National Courts

Bolivia is strongly affected by the impacts of climate change. In the light of the urgent need to enhance climate action in order to reduce the vulnerability of the country and increase its resilience, this chapter explores the opportunities and challenges of taking climate change cases before national courts. Based on the analysis of the country’s international commitments on climate change and constitutional and legal provisions, this study discusses the potential avenues for bringing climate cases against the government and both public and private actors. The analysis demonstrates that there are valuable opportunities for promoting climate litigation in Bolivia, especially by using rights arguments as legal foundation of constitutional claims. However, to achieve formal success, individuals in Bolivia will need to overcome different legal, social and political challenges. Yet, momentous cases in other jurisdictions may inspire individuals to bring climate-related cases before national courts, hence raising the profile and awareness on climate change issues in the Andean country.

In 2015, the UN adopted the 2030 Agenda and the Sustainable Development Goals (SDGs), a set of universal goals in key areas of action linked to sustainable development. The SDGs address not only highly relevant socioeconomic issues, but also pressing environmental challenges associated with the Anthropocene, such as climate change. The integration of a specific climate goal – SDG 13 – into the SDGs is paramount as climate change is a global and urgent threat compromising the realisation of all the SDGs. However, the SDGs’ focus on issues linked to the current economic growth pattern and development paradigm may prevent them from addressing the climate crisis and the inequalities and injustices associated with it. This paper attempts to establish the extent to which the SDGs promote progress towards achieving climate justice or if, on the contrary, they maintain the status-quo and continue to fuel the climate crisis while leaving millions behind.
