This article aims to analyze the phenomenon of arranged marriage traditions in the Islamic boarding school world from the perspective of the KUPI fatwa trilogy. The KUPI fatwa trilogy, namely the ma’rūf (kindness), mubādalah (reciprocity), and true justice approaches, is used to investigate the phenomenon of arranged marriage traditions in the world of Islamic boarding schools. This article uses a library research method with a phenomenological approach which is analyzed using the KUPI fatwa trilogy. Therefore, the nature of this research is descriptive-analytical. Then data collection techniques come from primary and secondary materials. Meanwhile, the analysis technique uses Miles and friends’ qualitative data analysis techniques, which consist of data condensation, data presentation, and drawing conclusions. The research results show that the tradition of matchmaking in the Islamic boarding school world has given rise to two characters and models of matchmaking in the Islamic boarding school world, firstly the one-way matchmaking tradition which is coercive, and secondly the two-way matchmaking tradition which is not coercive. Salafi Islamic boarding schools which are still conservative still carry out the tradition of one-way matchmaking which is coercive and one-sided, by denying women the opportunity to participate and hear their opinions regarding matchmaking. This results in injustice and tyranny towards women, so the tradition of this type of arranged marriage is contrary to the KUPI fatwa trilogy, because women are positioned as objects rather than equal subjects. However, it should be noted that not all Islamic boarding schools follow the custom of one-way arranged marriage, instead, there is a more egalitarian custom known as two-way arranged marriage, where women are treated as subjects with the same rights and freedoms as men. This is in line with the KUPI fatwa trilogy, because the practice of matchmaking like this is a tradition of fair matchmaking and supports women in order to give birth to ma’rūf (kindness), mubādalah (reciprocity), and true justice. The Miftahul Huda II Bayasari Ciamis Islamic Boarding School is one of the Islamic boarding school institutions that perpetuates the tradition of two-way matchmaking which is non-coercive and in accordance with the spirit of the KUPI fatwa trilogy.

This study aims to review Rasyid Ailal’s thoughts about the book Sahih Al-Bukhari and provide some criticisms of the results of the character’s thoughts reviewed by Rasyid Ailal in his book Sahih al-Bukhari Nihayah Usturah. Rasyid Ailal’s efforts to criticize S|ahih{ al-Bukhari created the potential for a great level of anxiety for the Muslim community. This is because this book is often referred to in every breath of Muslim activity. This paper uses the library research method. The data analysis technique is data condensation, data presentation, and conclusion. The results of the study show that Rasyid Ailal’s thoughts are indeed very critical, it can be seen from his view that the scholars did not think of it, both from the subjectivity of Imam Bukhari to the quality of his Al-Bukhari, all of which were criticized. However, many of Rasyid Ailal’s criticisms do not have good arguments, and one might even say that his thoughts are just assumptions with no scientific basis. Therefore, this thought cannot be evident and is not permissible to follow because it can be misguided or misguided

It becomes a dilemma when Muslim communities cannot apply Islamic criminal law. In fact, a law is not only to be understood but also believed to be true by Muslims themselves. So, it is appropriate that the punishment for adultery is less likely to have a deterrent effect on the perpetrator. This is because, apart from conventional criminal law being poorly understood by the Muslim community, the sanctions are also quite light so that the deterrent effect desired by law enforcers cannot be realized. This research aims to analyze adultery law by applying linguistic approaches and ushul fiqh to adultery law. This type of research is normative law using a language and ushul fiqh approach. The data sources were primary and secondary, while data collection techniques were observation and literature study. The results of this research show that adultery is analyzed using a language and ushul fiqh approach is the perpetrator of a criminal act who deliberately commits the elements of inserting male genitalia into female genitalia (in intercourse), which is unlawful according to the substance of the act, not because subḥāt and women bring lust. The punishment for adultery is to jilīd one hundred times. This penalty can be applied if the legal action has been legal before the court by presenting four witnesses. The stipulated punishment cannot be changed with other types of punishment because the punishment is regulated by the text of the Al-Quran.

The Tariqa and Islam in general are not against worldly and materialistic pursuits. Even in Islam, there are strict rules governing matters related to economic life or what is called muamalah. The four pillars of the Idrisiyyah congregation which are growing rapidly in the Tasikmalaya region of West Java Province are the basis for the teachings of asceticism in the growth and empowerment of the Islamic economy. This article discusses entrepreneurship education in tarekat Islamic boarding schools with a study of the Idrisiyyah tarekat doctrine in developing the congregation’s economy in Tasikmalaya, West Java. This article uses case studies and qualitative research methodology. Primary data sources are obtained from interviews, observation, and documentation techniques, while secondary sources come from books, journals, theses, and articles that are relevant to the research topic. The research was conducted from March 14 to March 30 2023 at the Idrisiyyah Tasikmalaya Islamic Boarding School, West Java. Data analysis techniques utilize the methods popularized by the Miles and Huberman models, namely data collection, data reduction, data presentation, and drawing conclusions. The findings show that the Sufi concept and doctrine of the Idrisiyyah tarekat serve as the basis for the entrepreneurship education given at the Idrisiyyah Tasikmalaya Islamic Boarding School. The history of the involvement of the Prophet Muhammad in the field of trade is the cornerstone of the economic success of the Idrisiyyah order. In addition, there are principles that must be adhered to in living an economic life in the Idrisiyyah order, namely the principles of divinity, scripture, worship, agreement, imamate and leadership. (Tarekat dan Islam pada umumnya tidak bertentangan dengan pengejaran duniawi dan materialistis. Bahkan dalam Islam, terdapat peraturan ketat yang mengatur hal-hal yang berkaitan dengan kehidupan ekonomi atau yang disebut dengan muamalah. Empat pilar tarekat Idrisiyyah yang berkembang pesat di wilayah Tasikmalaya Provinsi Jawa Barat menjadi landasan ajaran zuhud dalam pertumbuhan dan pemberdayaan ekonomi Islam. Artikel ini membahas pendidikan kewirausahaan di pondok pesantren tarekat dengan studi atas doktrin tarekat Idrisiyyah dalam pengembangan ekonomi jamaah di Tasikmalaya Jawa Barat. Artikel ini menggunakan studi kasus dan metodologi penelitian kualitatif. Sumber data primer didapat dari wawancara, observasi, dan dokumentasi, sedangkan sumber sekunder berasal dari buku, jurnal, tesis, dan artikel yang relevan dengan topik penelitian. Penelitian dilaksanakan pada tanggal 14 Maret sampai dengan 30 Maret 2023 di Pesantren Idrisiyyah Tasikmalaya Jawa Barat. Teknis analisis data memanfaatkan metode yang dipopulerkan oleh model Miles dan Huberman, yaitu pengumpulan data, reduksi data, penyajian data, dan penyusunan kesimpulan. Temuan menunjukkan bahwa konsep sufi dan doktrin tarekat Idrisiyyah berfungsi sebagai dasar untuk pendidikan kewirausahaan yang diberikan di Pesantren Idrisiyyah Tasikmalaya. Sejarah mengenai keterlibatan Nabi Muhammad SAW dalam bidang perdagangan merupakan landasan keberhasilan ekonomi tarekat Idrisiyyah. New Marriage Agreement: Maqashid Sharia-Based Marriage Agreement Model as a Solution to Strengthen Family Resilience

This article aims to discuss marriage agreements in strengthening family resilience in Indonesia and tries to implement them with a different concept than the previous concept through the basis of Maqashid Syariah as its construction epistemology. This article is a juridical-normative research, which uses the maqashid sharia approach and gender through descriptive-qualitative analysis. This article finds that marriage agreements in Indonesia are described or based on several existing laws, including; the Civil Code, Marriage Law (UUP), and Compilation of Islamic Law (KHI). The marriage agreement must be implemented because the marriage agreement itself is considered very important to be formed by each family because it can lead the family to become sakinah, mawadah, and waramah. In addition, marriage agreements, both formal and substantial, need to be revised in detail and not discriminate so that they have a new concept that is more up-to-date and represents legal objectives so that it can strengthen the resilience of families in Indonesia, the impact of which is to reduce the ever-increasing divorce.

Sex recession is increasing from year to year in various countries. This phenomenon has the opportunity and potential to have a negative impact on the future of the younger generation and even the world’s population because it causes harm to many aspects, such as economic, political, socio-cultural, and religious aspects. This article aims to describe the law of sex recession from the viewpoint of Islamic marriage law and seeks to formulate the concept of policies to minimize sex recession in the world, especially in Indonesia, through maqashid sharia as the basis for its formation. The research method used is juridical-normative with a philosophical and conceptual approach. The theory used is maqashid sharia. The results of this research show that the sexual recession threatens the life of the nation and state. This is proven by the many impacts experienced by many countries, both from an economic, socio-cultural, political, and religious perspective. So, countries are flocking to make policies to reduce the sex recession. The authors offer policy concepts that can be considered, such as strengthening pre-marital education, increasing family resilience, efforts to minimize divorce, and building awareness in the Muslim community regarding marriage law, where these policies are conceptualized based on maqashid sharia. Policies that have clear direction can minimize the sexual recession effectively and efficiently in people’s lives.

This paper describes the political contestation in the election of leaders that has occurred in the last five years in Indonesia. Since the reformation era, conservative Islamic movements have gained wide freedom to spread Islamic political ideology such as the idea of upholding Islamic law. This was clearly seen in the 2017 Jakarta Gubernatorial Election and 2019 Presidential Election, where the conservative Islamic movement voiced practical political aspirations by involving the role of religion. The case that happened to Basuki Tjahaja Purnama (Ahok) who was suspected of committing blasphemy at the end of 2016, turned into a protest movement that held “Aksi Bela Islam I, II, III” (Action for Defending Islam I, II, III) which was able to mobilize all elements of religious organizations in Indonesia. This movement is also supported by the role of social media which adds to the massive Islamic populism movement to promote the enforcement of Islamic law through the political stage. This is a qualitative research that prioritizes bibliographic sources. The results of this study indicate that the voices of Muslims who are involved in the “Action to Defend Islam” add to the success of the conservatism process which has a dichotomy of political interests to realize religious authoritarianism by using the Qur’anic verses. However, this study also explains the characteristics of the attitudes of leaders in the history of Islamic civilization who uphold egalitarianism that does not conflict with the democratic system because the responsibility of a leader is to create prosperity and justice for all mankind.

p>This article aims to discuss the religious dimension in political conflict and violence in Indonesia Indonesian society is heterogeneous, especially in religious affiliation. A series of cases of violence in Indonesia involving religion, such as the events in Pekalongan (1995), Situbondo (1996), Poso (1998), Ambon (1999), Tasikmalaya (1996), Sukabumi (2008), and also other violence in several parts of Indonesia . This incident caused various kinds of losses both in terms of community facilities and the many casualties that fell. This is based on an excessive commitment to the religious aspects of Indonesian society... The method used in this article is a qualitative research method that consists of library research. Thus, the data obtained comes from literary sources such as books, scientific articles, research reports, and so on. The data analysis technique is a qualitative data analysis technique of Miles et al. The results of the study show that the religious dimension is the main factor in the various events of political conflict and violence in Indonesia. These religious-based conflicts are used by political elites to gain political power. The various religious and political conflicts and violence is due to hyper commitment in most religious societies and the factor of religious differentiation. </p


The Concept of Kafa’ah in the Nineteenth Century Javanese Muslim Scholars’ View: A Study on the Ulama Rifi’yah’s Thought

This study aims to analyze the views of the Rifa’iyah scholars in Kandeman District, Batang Regency, regarding the concept of kafa’ah in marriage, as well as to know and understand the factors behind the concept of kafa’ah that they constructed. This juridical-sociological research used a historical-sociological approach. The results showed that in the views of the Rifa’iyah scholars in Kandeman District, Batang Regency, towards the concept of kafa’ah, which is interpreted as equal or balanced, Rifa’iyah scholars in the area understand that the urgency function of kafa’ah lies in creating a harmonious family even though kafa’ ah does not determine whether or not a marriage is valid. According to Ulama Rifa’iyah, the essential criterion for kafa’ah must be of the same religion. Then, the scholars provide recommendations following the formation of the kafa’ah conception contained in the Tabyinal al-Islah Book that a prospective wife must be of a lower degree than a prospective husband so that a wife respects/obeys her husband. However, if the context is the other way around, it is not a problem as long as the wife obeys her husband. The concept of kafa’ah, formed among the Rifa’iyah scholars in Kandeman District, Batang Regency, was caused by various factors, including religion, beauty, lineage, and wealth. Fragmentation of Dakwah Media: Exploring Exclusive Islam in Indonesia Post-Reform Popular Islamic Novels

This article aims to highlight Islamic exclusivism in the form of popular Islamic novelS for children’s reading books in Indonesia after the reform of 1998. Building on the media theory of Gill Branston and Roy Stafford, this study explains Islamic pop novels as Islamic educational materials from a semiotic approach, structuralism, and critical discourse analysis. In particular, this study uses qualitative research methods by descriptively analyzing the reading of Islamic pop novels spreading in the Qur’anic Education Centre in Central Java. The results showed that since the Reformation, the movement used books, newsletters, magazines, and children’s readings of Islamic pop novels to shape the religious thoughts of urban Muslim children and youth in Indonesia. There is hardly a story related to diversity, the value of tolerance, and mutual respect between religious people in those materials. The awareness of religious comprehension in children's reading seems exclusive. It must be realized by various parties that the media utilizing Islamic literature is very influential on the growth and development of children's religious thinking in the educational space in the metropolis.
