Background: In society, children have a highly vulnerable position, as their physical and mental condition is not yet strong and mature. There have lately been many cases of crimes against morality which involve children, especially the crime of sexual violence, including incest. Objective: This paper aims to analyze: (1) the law on child victims of incest applied at the Ternate City Police Force and (2) the obstacles in applying the law to protect child victims of incest at the Ternate City Police Force. Methods: This research was classic doctrinal research which employed a statute approach and a library approach. To collect data in this study, the researchers employed literature and legislation studies. Results: It was found that efforts provided for victims of underage sexual intercourse and rape in the criminal justice system are implemented through preventive and repressive approaches carried out by both the community and the government. Perpetrators of incest rape are charged with 3 legal regulations, namely the Sexual Violence Crime Law, the Criminal Code, and the Child Protection Law. The existing obstacle is that not many people understand the process of handling incest cases which should be punished more severely than ordinary rape.

Illegal mining is a latent problem that cannot be overcome since the Reformation era until today in Bangka Belitung, with widespread impacts on environmental, social and financial losses. Indications of mining management failure are due to ineffective legal arrangements by the government. The analysis of article aims to test the effectiveness of law and regulations related to locals tin mining carried out in Bangka Belitung, the regulation of local wisdom by the community, and the potential to integrate these two aspects in an ideal law enforcement perspective. The interests of environmental conservation and limiting the rate of illegal tin mining are two aspects that are currently fundamental needs, while still requiring the presence of economic and cultural considerations of the community. Through a socio-legal approach, it can be seen that the people of Bangka Belitung have implemented a unique ecoliteracy concept through local wisdom applied in the living culture of the community. The ecoliteracy that is carried out through the active participation of the people is timah ampak. The results of the study, it was found the condition that ampak is very prospective to be integrated in legislation, as well as being a solution to the phenomenon of ‘lame-duck’ regulations that have not been sufficiently implemented due to substance issues. The recommendation of this study is the transformation of local wisdom in local regulations to re-streamline the management of illegal tin mining in Bangka Belitung.

This study examines the harmonization of criminal law with societal socio-cultural aspects, elucidating the pursuit of substantive justice at normative and theoretical levels. Achieving concordance between legal norms and community culture necessitates comprehensive law reform – an imperative alternative, particularly for nations with legal histories shaped by foreign legal traditions. Focusing on the evolution of Indonesian criminal law post the enactment of the New Criminal Code, this research unveils fundamental shifts in values, norms, and paradigms. The transition from colonial legal substance to a modern, authentic framework is evident in articles implicitly prioritizing substantive justice, aligning with Indonesia’s philosophy and socio-cultural values. Over time, Indonesia has phased out colonial law, integrating living law into the national legal fabric. The paradigmatic shift, aimed at infusing Indonesian law with a distinctive national character, presents conditions, advantages fostering substantive justice, and challenges in formulation and implementation. Despite complexities, the 63-year process of drafting the New Criminal Code has yielded profound results, enhancing the legal system. This transformative journey signifies a deliberate departure from colonial legal paradigms, embracing a framework resonating with Indonesian values. The shift underscores Indonesia’s commitment to substantive justice and resilience in overcoming challenges tied to legal reforms.

Masyarakat yang tergabung dalam POKDARWIS Bekawan Desa Kotakapur berupaya menjadikan desa wisata sejarah sangatlah tidak mudah, butuhnya peran serta Pemerintah Kabupaten dan dinas terkait dalam mengatasi satu persatu permasalahan yang menjadi kendala dari pembangunan situs tersebut Permasalahan dalam penulisan ini adalah bagaimanakah ruang lingkup Pokdarwis sebagai organisasi kemasyarakatan ? dan kedua bagaimanakah Urgensi Badan Hukum Pada Organisasi Kemasyarakatan (Ormas) Berbentuk Perkumpulan ?. Permasalahan akan dianalisis menggunakan metode penelitian Normatif, dengan menghasilkan jawaban yaitu pertama, Pokdarwis adalah organisasi kemasyarakatan berbentuk perkumpulan, kedua, urgensi badan hukum pada Pokdarwis adalah kedudukan hukumnya menjadi subyek hukum. ABSTRAK etentuan pidana Pasal 162 UU Minerba menetapkan perbuatan menghalang-halangi kegiatan usaha pertambangan sebagai perbuatan pidana (delik). Tujuan penelitian ingin mengetahui secara kritis tujuan pemidanaan delik Pasal 162 dalam perspektif kebijakan kriminalisasi. Asas manfaat yang diharapkan agar dapat melihat secara objektif dalil teori kriminalisasi, sehingga dapat memberikan masukan bagi pembentuk undang-undang dalam memformulasikan ketentuan pidana. Metode penelitian menggunakan penelitian hukum normatif. Hasil penelitian menyimpulkan kebijakan kriminalisasi pada delik Pasal 162 tidak dapat dibenarkan menurut teori moral dan teori liberal individualistik. Hakikat nilai moralitas masyarakat terdistorsi dengan keberlakuan delik tersebut. Negara telah membatasi ruang kebebasan warga negara untuk hidup merdeka menyampaikan dan memperjuangkan hak-hak dasarnya. Bahkan kebijakan kriminalisasi yang dilakukan oleh pembentuk undang-undang tidak mendapat legitimasi yang kuat dari esensi tujuan pemidanaan yang sejalan dengan prinsip nilai, prinsip kemanfaatan, dan prinsip kemanusiaan. Rekomendasi kedepan agar kebijakan legislasi haruslah dilakukan dengan pendekatan rasional dan pendekatan kebijakan. Kata kunci: teori kriminalisasi; kebijakan; pemidanaan; pertambangan. ABSTRACT riminal provisions Article 162 of the Minerba Law stipulates that obstructing mining business activities is a criminal act (offense). The research objective is to know critically the purpose of criminalization of Article 162 in the perspective of criminalization policy. The principle of benefit is expected to be able to see objectively the arguments of criminalization theory, so that it can provide input for legislators in formulating criminal provisions. The research method uses normative legal research. The results of the research conclude that the criminalization policy on the offense of Article 162 cannot be justified according to moral theory and liberal individualistic theory. The nature of the moral values of society is distorted by the enactment of this offense. The state has limited the space for the freedom of citizens to live in freedom to convey and fight for their basic rights. Even the criminalization policies carried out by legislators do not get strong legitimacy from the essence of the purpose of punishment which is in line with the principles of values, principles of benefit, and principles of humanity. Future recommendations so that legislative policies must be carried out with a rational approach and a policy approach.
