É por meio da personalidade que a pessoa poderá adquirir e defender seus bens e direitos, entre eles, a vida, a honra, a liberdade etc. Os direitos da personalidade são mencionados em capítulo próprio no Código Civil de 2002 15 (arts. 11 ao 21), contudo muitos autores, como Szaniawski (2002) (BRASIL, 1988), anunciada como um dos fundamentos da República, seria uma cláusula geral de proteção da personalidade, assegurando o ser em sua totalidade, diante de toda e qualquer situação que implicasse ofensa ao que o ser humano teria de mais caro, a sua individualidade e, consequentemente, personalidade (SZANIAWSKI, 2002).
