Sinergi Antara Kepolisian, Kejaksaan Dan Komisi Pemberantasan Korupsi (KPK) Dalam Pemberantasan Tindak Pidana Korupsi Di Indonesia

Abstract

CEC (Corruption Eradication Commision) is a government agency. Its duties include investigating and prosecuting corruption cases and monitoring the governance of the state. It has the authority to request meetings and reports in the course of its investigations. It can also authorize wiretaps, impose travel bans, request financial information about suspects, freeze financial transactions and request the assistance of other law enforcement agencies. Law Of The Republic Of Indonesia Number 30 Of 2002 talks about CEC’S dutties and authorities to established to fight corruption. Authorities between Indonesia National Police and Indonesian National Prosucetor are crashing, according to some people, the causing reason of this crash because of techincal system and adminstration system. Writer said this is supposed to be not the reason of the crashing since the theory of law said “lex spesialis derogate lege generali” . The authorities system between Indonesia National Police and Indonesia National Prosecutor in global specific corner could be taking by some reasons. This Thesis is using analysis description, which is talking from the view of the situation and condition that happening on the point of the problems between Corruption Eradication Commision, Indonesia National Police and Indonesia National Prosecutor. This thesis using Normative Law to had the research according to the norm of methods, rules of law and some juridism decisions, which is related with function and authorities synergy between Corruption Eradication Commision, Indonesia National Police and Indonesia National Prosecutor in public cases especially on investigate corruption cases. That’s why the corrdination between Corruption Eradication Commision, Indonesia National Police and Indonesia National Prosecutor needed so much to prevent from missunderstanding from negatives rivalities between them. If that problem is not prevented it will give obstacle to fight the corruption cases and these days is happened the corruption cases mostly having dead lock because of the uncoordinate between those government agencies and negative coordination, for example the mob justice. 077005118
