From the streets to the statehouse: how tenant movements affect housing policy in Los Angeles and Berlin

How can tenants affect housing policy? This paper compares rental housing politics in Los Angeles (USA) and Berlin (Germany) between 2008-2020 by examining how political processes influenced policy. It serves as a case of the emergence, escalation, and impact of tenant power. Tenant movement organizations employed five mechanisms to affect policymaking: (1) making demands, (2) forming coalitions, (3) promoting referendums, (4) engaging government officials in dialogue, and (5) transferring agents to government. The paper draws on multiple data sources, including interviews and participant observation over ten years. The cities witnessed policy episodes with four parallel characteristics: (1) locally progressive and regionally moderate, (2) shifting from defensive to offensive, (3) shifting from particular to universal, and (4) signs of a breakthrough beyond neoliberal housing policymaking. The findings suggest that the rise of tenant movements and their allies help drive policy change via multiple channels, exhibiting both similarities and differences across cities, especially in terms of money power and people power.

Trespassing on the Law: Critical legal engineering as a strategy for action research

This paper proposes Critical Legal Engineering [CLE] as a new methodology for legal‐geographic action research. While legal geography is on the rise, geographers rarely participate in legal or judicial process, and when they do – for example as court expert witnesses – they merely respond to the preestablished agendas of the legal system. I argue that legal geographers’ knowledge on the nature of law and its relations with society is a source of power that could allow them to set legal agendas and pluralize legal discussions. CLE assumes that legal geographers can put forward technical legal arguments, thus using law’s own tools to implement normative agendas implied in critical research. However, CLE demands a dialectical attitude that preserves the contradiction between political ends and legal technology – while pursuing both of them at the same time. As I show, CLE can realize critical agendas in three ways. First, it coopts the legitimacy provided by the legal system, lending it to the agendas that are otherwise perceived as ‘too radical’. Second, elevated by the law these radical agendas may gain greater power to influence political‐economic realities even before the legal outcomes are decided. Finally, CLE draws out of ‘technical’ legal discussions into the heat of the public debate, thus politicizing the law. Having developed this methodological proposition in the course of my research on urban movements, I illustrate it with the strategy of Berlin’s campaign Deutsche Wohnen & Co. Enteignen [DWE] which has crafted a legal argumentation based on Art. 15 of the German Constitution to pursue remunicipalizion (or de‐privatizaton) of housing.

Bislang war in deutschen Städten das Wohnen im Eigentum – entweder im Eigenheim oder in der Eigentumswohnung – die Ausnahme. Insbesondere in Großstädten dominierte das Wohnen zur Miete. Gegenwärtig ändert sich dies: Großstädte wie Frankfurt, Berlin, Hamburg, Köln und München sind gegenwärtig geprägt von einer Kauflust privater und institutioneller Investoren. Zugleich hat in vielen Städten ein Ausverkauf und/oder Vermarktlichung des öffentlichen Wohnungsbestandes stattgefunden. Dies hat dazu beigetragen, dass die Preise sehr stark angestiegen sind. In dem Beitrag wird die aktuelle Entwicklung auf städtischen Wohnungsmärkten in Deutschland als Folge einer Finanzialisierung von Immobilien sowie einer Responsibilisierung im Bereich der Wohnversorgung analysiert. Es wird gefragt, welche Folgen dies in Städten hat.

Sebastian Schipper untersucht die sozialen Proteste gegen die Neoliberalisierung der Wohnraumversorgung, die sich angesichts steigender Mieten und Wohnungspreise in den letzten Jahren vielerorts formiert haben. Am Beispiel von Frankfurt am Main und Tel Aviv-Jaffa analysiert er vergleichend, inwiefern solche Widerständigkeiten eine signifikante Abweichung von Prozessen der Vermarktlichung und Privatisierung anstoßen können. Gelingt es städtischen sozialen Bewegungen, darauf hinzuwirken, dass die Versorgung mit Wohnraum der Marktlogik entzogen und aus Kreisläufen der Kapitalverwertung herausgenommen wird? Zeichnen sich in den gesellschaftlichen Auseinandersetzungen Konturen eines entstehenden postneoliberalen Regimes der Dekommodifizierung des Wohnens ab? Im Sinne einer aktivistischen Stadtforschung wird herausgearbeitet, welche politischen Alternativen zur Realisierung bezahlbaren Wohnraums in den sozialen Kämpfen zum Vorschein kommen, und strategisch nach ihrer Durchsetzbarkeit gefragt. Kommunale Bürgerbegehren und die Wohnungsfrage. Der ‚Mietentscheid‘ in Frankfurt und sein schwieriges Verhältnis zur institutionellen Politik

Zusammenfassung Am Beispiel des kommunalen Bürgerbegehrens Mietentscheid in Frankfurt am Main argumentiert der Beitrag erstens, dass es primär soziale Bewegungen sind, die innovative Vorschläge zur Lösung der Wohnungskrise entwickeln, welche auf einen strukturellen Umbau der Wohnungsversorgung entlang der Leitlinien Bezahlbarkeit, Dekommodifizierung und Demokratisierung abzielen. Allerdings zeigen sich institutionelle Politik und politische Administration im Verhältnis zu wohnungspolitischen Bewegungen oft verhärtet. Der Mietentscheid steht daher zweitens zugleich sinnbildlich für eine postneoliberale Konstellation, in der zivilgesellschaftliche Initiativen zwar großen gesellschaftlichen Zuspruch erfahren, jedoch von staatlichen Entscheidungsträger*innen mittels diskursiver Strategien der Delegitimierung, juristischer Strategien der Verzögerung sowie politischer Strategien der selektiven Einbindung ausgebremst werden. Obschon kollektive Akteure wie der Mietentscheid unter Umständen gewisse Zugeständnisse durchsetzen können, bleibt ein grundlegender Paradigmenwechsel in der Wohnungspolitik blockiert.
