Evolution of R&D state aid in Poland in the context of Multiannual Financial Perspectives

Abstract

The aim of this article is to identify legislative-programmatic changes, as well as the scope and directions of research & development (R&D) aid granted in Poland after the accession to the European Union, in the context of Multiannual Financial Perspectives. The changes introduced into relevant legislation in the EU and Poland, and aid programmes implemented throughout three Multiannual Financial Perspectives were analysed. This was followed by in-depth statistical analysis of changes in granting state aid for R&D in Poland. The authors found in this study a strict correlation between R&D aid in Poland and changes arising from the successive financial perspectives. Small enterprises have been the greatest beneficiaries of these changes.

Legal basis for R&D aid,
and Polish R&D aid schemes
Beginning with accession to European structures, all of the Union legislation on
state aid, including R&D aid, became the law of the land. The key document was the

The aim of this study is therefore to identify and define the directions of state aid policy in Poland after accession to the European Union by capturing changes in the value, intensity and allocations of state aid. First, the total nominal value of state aid granted in Poland and the Relative State Aid Intensity Index, which measures the involvement of member states in market interventions against the EU as a whole, are presented [Ambroziak, 2021]. Then, the parallels between the structure of state aid provided in Poland and that offered in other member states are outlined. To this end, the developed State Aid Similarity Index was used [Ambroziak, 2021]. Thirty years ago, the Europe Agreement establishing an association between the European Communities and their Member States and Poland came into force. Twenty years ago, Poland, along with most of the Central and Eastern European Countries, joined the European Union. These two anniversaries have provoked the researchers from the Department of European Integration and Legal Studies (www.sgh.waw.pl/kiipe) SGH Warsaw School of Economics to prepare a monography "Poland in the European Union. Report 2024. 20 Years of Membership: Experiences and Foresights” (https://www.sgh.waw.pl/kgs/publikacje-pracownikow-katedry-integracji-i-prawa-europejskiego). This is the fifth annual report of the Department on the evolution of relations between Poland and other EU Member States. In these reports we have discussed the issues we believe to be the most relevant to Poland's integration process within the European Union. Each year we concentrate on issues we believe are of most interest, touching on both the economic and legal spheres. In the first chapter of this year’s report, titled “Changes in Poland’s foreign trade after accession to the European Union”, Elżbieta Kawecka-Wyrzykowska found that growth in Poland’s foreign trade was impressive during the surveyed period, and this was the case with both other EU partners and extra EU countries. In the 21st century, Poland has been one of the countries with the fastest growth in exports to other EU countries, in relative terms, which has strengthened its position among EU suppliers – reaching a 6% share in intra-EU exports and imports in 2022. Immediately prior to accession, and beyond, EU suppliers covered just over 65% of Poland’s import needs. In the last two years, this figure has barely exceeded 50%, which largely reflected the differences in the scale of price increases for basic products imported from the EU and from outside the EU. EU partners’ position in Poland’s exports has been much stronger: around 70 % through the whole period. Both, exports to the EU partners and to third countries are dominated by industrial products – around 80% in recent years. Agricultural products amount to around 15% in exports in both geographical directions. In the chapter, titled “The evolving role of the European Union in Polish trade in services and major developments of the intra-EU services trade of Poland“ Dariusz Mongiało reveals that Poland was a net exporter to the EU market of services. It is also shown that Germany stands as the key destination of the Polish services and their top supplier to Poland (occupying the same, first position as in Poland’s trade in goods). Polish most important export services delivered to the EU Internal Market are currently: transport, other business services and ICT. The existence of two-way flows confirms a high degree of similarity between the Polish economy and the economies of other EU countries as regards road transport, computer services and in travel. This two ways trade in services suggests also that Polish service companies operating in these branches could take advantage of the benefits from intra-industry specialization as well. In the next chapter, titled “Poland and the EU economic and monetary union”, Artur Nowak-Far shows that in the pre-accession period, participation in the full EMU was seen both by the EU institutions and the Polish government(s) as a clear consequence of EU membership. Nevertheless, the agenda related to Poland’s transition to full EMU membership was undermined by the apparent lack of robustness of the EMU construct during the 2008+ global financial crisis and in 2015 by an obvious political shift in public sentiment towards a more Eurosceptic political stance. The most important tactical ramification is that during major economic stress (i. e. the 2008+ global economic crisis and the COVID-19 crisis) Poland retained much broader room for manoeuvre in economic policy than it might have had with the euro area. Moreover, over recent years, Poland has experienced a high degree of real convergence with the euro area. In chapter four, titled “Poland’s environmental policy after accession to the European Union”, Marzenna Błaszczuk-Zawiła shows that as EU Member State, Poland has met many of its environmental commitments on time. Some of them (transposition of certain directives) were implemented behind schedule, while on some issues it is still difficult to predict the timeline for compliance. Between May 2004 and December 2022, the Commission opened 120 infringement proceedings against Poland in relation to environmental legislation (especially in waste management, air and water quality, and nature conservation). Many of the environmental issues faced by Poland remain a major challenge for most or a large group of EU Member States, due to reasons such as the high level of environmental protection prescribed by EU law. The next chapter, titled “From emigration to immigration – how EU membership changed migration-related challenges in Poland”, by Michał Schwabe, reveals that although the first years of Poland’s EU membership only confirmed Poles’ wish to emigrate to the West for work, since the second decade of the 21st century, the character of Poland as a country of emigration has begun to gradually change. Emigration of unskilled labour to the West created a growing demand for labour, especially for seasonal workers in the agricultural sector. This demand was met primarily by an increasing scale of immigration from the former USSR countries (mainly from Ukraine). A positive migration balance was recorded in Poland for the first time in 2016, and just one year later, i.e. in 2017, Poland was the country with the largest number of temporary foreign workers in the world according to OECD data. The crisis on the Polish-Belarusian border triggered by the Belarusian regime in 2021, as well as the unprecedented influx of forced migrants from Ukraine, who had to flee their homeland due to an unprovoked Russian invasion in 2022 are reflected in the analysis. The six chapter, titled “State aid in Poland after accession to the EU. Twenty years of financial interventions in the market economy” by Adam A. Ambroziak, presents that in the period of 2004–2021, Poland was constantly among the largest state aid donors and gradually increased its position. The nominal and relative value of aid provided in Poland was the highest in the first years after the start of successive EU multiannual budgets , indicating a considerable dependence of public interventions in Poland on EU funds. This trend was not accompanied by an equally rapid convergence in the structure of the support provided: this was especially true for R&D&I aid, but despite this, aid for environmental protection and energy efficiency was either far from sufficient or did not envisage allocations that followed European, trends. Chapter seven, by Tomasz Grzybowski, looks at “Europeanization of Polish judicial system (perspective of administrative judiciary)”. The presence of Poland in the EU and party to the Convention for the Protection of Human Rights and Fundamental Freedoms, and consequently the influence of European law on the Polish legal space, appear to be something self-evident, both in terms of law-making and especially law application. Regarding application of the law, there is, however, a widespread belief that an interpretive perspective based on the objectives of EU law, especially in harmonized areas, is something natural at the current stage of development of both national and EU legal systems. Therefore, the harmonization of legal cultures, and particularly their axiological foundations, took place not only at the level of the legal text, but also through legal discourse, expressed particularly in the dialogue of national and international court jurisdictions. In summary, successive reports prepared by a team of researchers from the Department of European Integration and Legal Studies at the SGH have shown that Poland's accession to the European Union has made it possible to achieve various goals. They facilitated the country's further economic and social development, such as a significant expansion of the market for Polish goods, stabilization of the economic law system, an impressive inflow of foreign capital needed to modernize the economy and create new jobs (in the form of direct investments as well as some European funds), etc. At the same time, new development challenges (including climate change, pressure from foreign migrants to access wealthier European countries, ensuring security of supply of critical raw materials, including energy, etc.) make it clear that the optimal path for economically and politically secure development of Poland is to deepen and broaden European integration and strengthen Poland's position in the EU. These are areas of interest and study by the staff of the Department of European Integration and Legal Studies.

Although the competition policy is the exclusive competence of the European Union, and state aid law is applied uniformly across the EU, it is up to the Member States to ultimately decide how to use and profile state aid. This article’s aim is to assess to what extent the state aid policies converged across the Visegrad Group countries after their accession to the EU. Hence, a statistical comparative analysis was conducted on changes in the value, intensity and purpose of state aid in the V4 countries. The study demonstrated that, in particular, the early years of the first and second full multiannual financial perspectives influenced the intensity and structure of state aid in the V4 countries. Although the main categories of aid are in line with those found in other Member States, support in the V4 countries is still structured differently to the EU average.

Lockdowns imposed by the European Union (EU) Member States produced significant consequences in the form of losses to companies, which is why the Member States decided to assist businesses from public funds. This paper aims to identify and initially assess the implementation of schemes under which coronavirus disease-2019 (COVID-19)-related state aid was granted in Poland in 2020 for different instruments and beneficiary sizes. The idea was to find out how well aforementioned schemes responded to the needs of companies affected the most by the COVID-19-inflicted crisis. To this end, statistical analysis was deployed to learn about the share of individual groups of businesses of different sizes in support instruments granted in relation with COVID-19 by type of aid. The study helped to demonstrate that Polish aid schemes approved by the European Commission in 2020 assisted mainly micro-and small-sized companies, which usually suffered from poor liquidity, by predominantly soft instruments.

Taking into consideration all changes in the EU law after Poland’s accession, one can assume, that directions and scope of public interventions should be similar among the EU Member States. At the same time, it is obvious, that they should take account of financial constraints, starting points and national/government preferences. Therefore, the primary goal of the chapter is to present Poland’s performance in the EU in terms of state aid granted after the EU accession. To this end we introduced two indices, which are based on works on trade by distinguished authors: Relative State Aid Intensity Index and State Aid Similarity Index. Our research allows us to formulate two observations: first, that state aid in Poland is subordinated to EU multiannual financial programmes in terms of available/offered financial sources, and second, the structure of state aid offered in Poland does not match the structure of public financial assistance observed in most other EU Member States. Poland still grants mailny regional investment aid, which does not require any sophisticated criteria, and only a small percentage of aid for environmental protection and energy, which would support innovation and, at the same time, is desirable in the face of climate change.

Celem niniejszego opracowania jest pogłębienie dyskusji o kierunkach polskiej polityki prze- mysłowej przez porównanie jej deklarowanych i rzeczywistych kierunków w latach 2007–2014. Autorzy opracowania zbadali w szczególności: skalę i strukturę wydatków na wsparcie branż przemysłowych w Polsce, a także dokonali analizy porównawczej kierunków zmian strukturalnych i deklarowanych celów polskiej polityki przemysłowej. W badaniach wskazano, że deklarowane kierunki polityki przemysłowej obejmowały m.in. podniesie poziomu technologicznego polskiej gospodarki, dopasowanie polskiego przemysłu do zmian strukturalnych w światowej gospodarce i podniesienie jego konkurencyjności. Przeprowadzone badania pozwoliły na wykazanie, że rzeczywista polityka przemysłowa, badana z perspektywy branżowych kierunków pomocy publicznej, nie odpowiadała w pełni deklarowanym celom polskiej polityki przemysłowej. Pomoc publiczna nie była kierowana do podmiotów produkujących dobra wysokiej czy chociażby średnio-wysokiej techniki, a do przedsiębiorstw działających w przemysłach średnio-niskiej techniki oraz podmiotów świadczących usługi rynkowe, tj. usługi detektywistyczne i ochroniarskie, transportu lotniczego oraz magazynowania i wspomagania transportu.

Competitiveness involves a variety of factors, however recently special attention has been paid to innovative solutions that have become crucial for the development of fi rms and economies. Due to the fact that there are many market failures identifi ed within research and development activities, many theorists, entrepreneurs and politicians accept granting R&D&I state aid to companies assuming that it should simultaneously contribute to the enhancement of innovation and, consequently, competitiveness of the EU economy. The paper is aimed at assessing the focus of state aid policy on research, development and innovation in the light of theory and practice (based on the recent experience). To this end we will analyse theoretical arguments for interventions supporting R&D activities, legal bases and criteria of admissibility for state aid for R&D&I, as well as, importance of R&D&I public aid in the EU Member States. The analysis of legal changes in conditions of admissibility of aid granted for research, development and innovation confirms that such aid belongs to the concept of improved economic competitiveness, also of the EU industry. However, like any government intervention, the aid should target only enterprises with real development potential and only when they are faced with market failures. As regards a position of state aid to R&D&I in public spending, remarkably, in the times of economic crisis more developed countries with higher GDP engaged more public budget resources into R&D&I activities.

Although tax incentives are an effective tool for promoting R&D&I, depending on their design they may qualify as State aid (article 107(1) of the TFEU) unless exempted by the Commission (article 107(3)). This article discusses the role of State aid rules in respect of R&D&I incentives and the need to ensure R&D&I promotion policies in Europe are on equal footing with the rest of the world, thus ensuring a level playing field for European undertakings in global markets.

At the turn of 2019 and 2020 the world economy experienced a slowdown resulting from the COVID-19 pandemic. Negative repercussions of the measures taken, related to the slowdown in economic activity, have been experienced by all EU Member States. The article aims to present the influence of the pandemic on the EU economy and to identify the selected EU measures and instruments implemented to counteract the implications of COVID-19 in 2020 and 2021–2027. The authors attempt to answer the following questions: (1) Will the actions taken by the European Commission and temporary state aid measures positively impact reducing the negative implications of the economic and social crisis caused by the pandemic? (2) Are the proposed instruments and their financing sources ensuring the recovery of the EU economy sufficient? The article puts forward a hypothesis that the prepared financial instruments implemented at the EU level should reduce the negative implications of the pandemic to some extent; however, close cooperation between the Member States and European institutions in terms of coordination of the implemented measures and instruments is necessary to render them more effectively. The authors utilise the descriptive, normative and diachronic methods. The analysis of the implemented remedial actions at the EU level and at the level of a Member State (Poland) leads to the conclusion that despite the economic crisis prevention measures introduced by the European Commission, the burden of counteracting the consequences of the epidemic rests mainly with the countries whose governments have introduced anti-crisis packages.

Na podstawie prawa Unii Europejskiej pomocą publiczną jest wszelka pomoc udzielona przedsiębiorstwom przez państwo lub przy użyciu zasobów państwowych w dowolnej formie. Pomoc oznacza korzyść, którą przedsiębiorstwo otrzymuje, a którą nie mogłoby uzyskać w ramach normalnej działalności gospodarczej. Zakaz udzielania pomocy publicznej w Traktacie o funkcjonowaniu Unii Europejskiej nie ma charakteru bezwzględnego ani bezwarunkowego. Beneficjentem pomocy publicznej mogą być również podmioty zajmujące się wytwarzaniem energii ze źródeł odnawialnych. Państwa członkowskie przyznając pomoc publiczną na energię ze źródeł odnawialnych, wskazują na przesłanki wymienione w art. 107 ust. 3 lit. b i c. Powołują się na konieczność zapewnienia bezpieczeństwa energetycznego, rozwoju konkurencji, efektywności ekonomicznej, uwzględnienia wymogów ochrony środowiska oraz równoważenia interesów przedsiębiorców i odbiorców energii.

This article fills the gap in the State aid literature by discussing the optimal rule for State aid assessment, which shall increase the reliability and accuracy of State aid enforcement by the European Commission. Moreover, it contributes to decision theory more broadly, by putting emphasis on the error in application of law, which hampers an effective distinction between desirable and undesirable measures. The argument developed in this article is that the informational asymmetries, which the Commission faces when assessing measures, may be overcome to a different extent at each procedural stage. Hence, and due to the interrelation between complexity of rules and the probability of error in their application, State aid assessment requires two assessment rules, one for the preliminary examination and one for the formal investigation. However, it seems that such optimal assessment rules have not been identified, and no concern about accuracy in application of complex rules is reflected in the literature or in the legal framework. Consequently, the Commission shall structure and make known the rules which guide its assessment, especially in the preliminary examination. This would benefit the quality and transparency of the decision-making and might be particularly valuable in the context of the on-going revision of State aid guidelines.
