RE-EXAMINING THE CABOTAGE ACT 2003 AND ITS IMPLEMENTATION

Abstract

The Nigerian Coastal and Inland Shipping Act (the Cabotage Act 2003) enacted by the national Assembly is a comprehensive piece of Legislation which has the objectives of, enhancing indigenous participation in the domestic coastal trade business, transfer technical skills to Nigerians create jobs within the shipping industry, conserve foreign exchange restrict unnecessary influence of foreigners in our domestic maritime business came into force in April 2004. Before the enactment of the Act, the Nigerian domestic maritime industry have always been dominated by foreigners and foreign companies with their attendant security challenges within our territorial waters besides chasing our local business men out of business because they do not have the financial and technical capacity to compete with the foreigners. This paper/article reviews the said Act against the backdrop of its objectives and see how far it has achieved those objectives. The paper concludes that thus far the Act has not done much because of the unnecessary politics involved by the administers of the Act especially Nigerian Maritime Administration and Safety Agency (NIMASA).
