CRITICAL EVALUATION OF CRIMINAL LIABILITY OF CORPORATIONS UNDER THE FEDERAL COMPETITION AND CONSUMER PROTECTION ACT, 2018
This paper Is a critical evaluation of the framework of corporate criminal liability under the Federal Competition and Consumer Protection Act. It evamines who ma;' he held liable for such crimes and under what circumstance such liability may be imputed. In the cosine of that, it analysed the provisions of Nigeria legislation to locate the legal basis for corporate criminal liability. The paper focuses on the concept of vicarious liability and the identification theory and concluded that the corporation would be liable only if it is proved that the corporate policy and culture encourages and favoured the commission of the offence.
