The application for judicial and formal review of the Job Creation Law was registered on November 12, 2020, with Case Number: 103/PUU-XVIII/2020. Regarding the formal test, KSBSI took issue with forming the Government Job Creation Law. This research uses a legal approach, which is to review all relevant. Data collection in normative legal research is divided into 3 (three) types or 3 (three) secondary data collection methods: literature studies, documents and archival studies. The Omnibus Bill or Omnibus Law is a technique for drafting laws and regulations that were drafted with the aim of the President overcoming regulatory obesity. Even though the technique for drafting the Omnibus Law, in terms of suitability of the writing format with Attachment II to the Law of the Republic of Indonesia Number 12 of 2011 concerning the Formation of Legislation, there are contradictions. The ratification of the Omnibus Law as a law means that the Omnibus Law, in the perspective of the Legislation hierarchy, is considered the same as other laws which are not prepared using the omnibus law method. p> Penelitian hendak meninjau bagaimana konsep awal penggunaan metode omnibus law dan bagaimana penerapan di Indonesia melalui UU Cipta Kerja. Penelitian ini menggunakan metode penelitian yuridis normatif yang bersifat deskriptif dan preskriptif, dengan pendekatan peraturan perundang-undangan (statutory approach), pendekatan konseptual (conceptual approach), dan pendekatan perbandingan (comparative approach). Hasil penelitian ini menunjukkan bahwa metode omnibus law menjadi pendekatan yang lumrah digunakan dalam tradisi hukum common law yang berfungsi dalam penyederhanaan hukum, berkembang dan diadopsi dalam tradisi civil law . Metode omnibus law memiliki khas berupa penggabungan dari banyak Undang-Undang yang dijadikan dalam satu Undang-Undang. Metode omnibus law menimbulkan masalah baru berupa kerumitan pembahasan dan berpotensi mengurangi hak publik, hal ini biasanya disebabkan karena terlalu kompleks isu hukum yang dibentuk, sehingga beberapa negara menerapkan konsep metode omnibus law dengan syarat relevansi isu ( single subject rule ). Omnibus law is a method of forming laws. The use of the omnibus law is often problematic from a democratic aspect. Omnibus law arrangements in Indonesia have been legalized through Law Number 13 of 2022, but it remains a problem regarding participation as a pillar of democracy. Therefore, the concept of comparison is needed for further refinement. This research is normative research with statutory, case study, and comparative approaches. The results of the study are: (1) the application of the omnibus law in Indonesia in the case of the Job Creation Law is undemocratic because it narrows the space for public participation, (2) changes to the Law concerning the Formation of Legislation, especially those relating to participation, representation of participation, and the provision of a two-way information system is a necessity for realizing a democratic omnibus law in Indonesia.

The corruption case in Indonesia, specifically the BTS project scandal by the Ministry of Communication and Informatics, reflects serious challenges in public financial management. According to information from Transparency International, Indonesia still ranks as a country with a high level of corruption. The BTS project, aimed at improving internet access in remote areas, has been revealed to suffer from budget misuse and corrupt practices by high ranking officials. To address this issue, forensic audits and digital evidence have become crucial tools in uncovering crimes. However, challenges such as a lack of trained human resources, limited technological infrastructure, and inter-agency coordination hinder the effectiveness of law enforcement. Integrated efforts to enhance the capacity of law enforcement and technological infrastructure are needed to effectively combat corruption and create a clean and transparent government.

This study analyzes the impact of Government Regulation in Lieu of Law (Perppu) No. 2 Year 2022 on Job Creation, particularly in the plantation sector, on the rights of Masyarakat Hukum Adat (MHA). The initial purpose of this Perppu was to increase investment through simplification of regulations and acceleration of licensing, but the formulation of existing norms and regulations can threaten the existence of MHA. This research is a normative research and uses a legislative approach by analyzing primary and secondary legal materials, and using John Rawls' Theory of Justice and Mochtar Kusumaatmadja's Theory of Development Law. The results show that there are significant changes in the application of Perppu No. 2 Year 2022 on Job Creation compared to Law No. 34 Year 2014 on Plantations, including changes in land area limitations, elimination of environmental permits, and elimination of criminal sanctions related to permits and the environment. The implications of the implementation of this Perppu are that it exacerbates the marginalization of Indigenous Peoples, ignores customary rights, and causes overlapping land tenure, as well as ecosystem and environmental damage. This research suggests several strategic steps: accelerating the inventory of customary land and the granting of customary rights certificates, requiring MHA to be involved in every stage of decision-making through FPIC mechanisms, and passing a special law for MHA. Investment policies should also focus on sustainable development with stricter environmental standards than at present.

Penelitian ini bertujuan untuk mengkaji secara kritis bagaimana pembentukan undang-undang di Indonesia dengan menggunakan metode omnibus pasca Undang-Undang Nomor 13 Tahun 2022 tentang Perubahan Kedua Atas Undang-Undang Nomor 11 Tahun 2012 Tentang Pembentukan Peraturan Perundang-Undangan. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Berdasarkan hasil kajian menunjukkan bahwa Pengaturan metode Omnibus dalam pembentukan undang-undang diatur dalam ketentuan Pasal Undang-Undang Nomor 13 Tahun 2022 tentang Perubahan Kedua Atas Undang-Undang Nomor 11 Tahun 2012 Tentang Pembentukan Peraturan Perundang-Undangan dan untuk tahapan impkementasi pembentukan undang-undang perlu dilakukan penyesuaian substansi di buku lampiran UU tersebut agar jelas proses pembentukan undang-undang de ngan menggunakan metode omnibus.

Penelitian ini membahas seputar iklim investasi di Indonesia dan peran penting hukum dalam mendorong pembangunan ekonomi dan sosial, dengan fokus pada perizinan, penataan ruang, dan izin pemanfaatan ruang. Dibahas juga konsep Omnibus Law dalam konteks sistem perundang-undangan di Indonesia, serta manfaat dan kelemahannya, khususnya terkait dengan Undang-Undang Nomor 11 Tahun 2020. Penelitian ini juga mengevaluasi perubahan dalam izin pemanfaatan ruang sesuai dengan Undang-Undang Nomor 26 Tahun 2007 dan perubahan pasca berlakunya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Terakhir, penelitian ini membahas implikasi Peraturan Pemerintah Pengganti Undang-Undang (Perpu) No. 2 Tahun 2022 tentang Cipta Kerja terhadap hukum tata ruang di Indonesia.
