The Implication of the Globalization on the Pancasila-Based Principles of Local Democracy in Indonesia

The liberalism principles have influenced the whole life aspects of the nation and the state of Indonesia. On the political aspect, the principles influence the elections in Indonesia from the lowest (village head election) to the highest (presidential election) levels. The liberal principles are not in accordance with the principles of Pancasila as the national philosophy and the source of law (staatsfundamental norm) of Indonesia. The liberal democratic principles cause high cost democracy. They create the conditions of ‘free fight’ and ‘homo homini lupus’, as well as many potential corruption practices in villages. In addition, it can lead to the most worrying issue –the damage of values of Pancasila.

Pancasila Democracy has consistently been a central topic in the discourse of Indonesian constitutional law. There appears to be a gap in understanding both doctrinally and in legal thought. Historically associated with the New Order government under the second period of the 1945 Constitution, Pancasila Democracy is perceived similarly in the Reformation Order under the amended 1945 Constitution of Indonesia. Although Pancasila Democracy remains a significant part of Indonesia's constitutional heritage, its foundational orientation has drastically shifted. The current democratic practices in Indonesia are seen as deviating from the original meaning and formulation of Pancasila Democracy. The Reformation Order's governance under the amended constitution reflects a liberal democratic character. There is a notable trend of integrating liberal democratic values into Pancasila Democracy, which dilutes the traditional values that have long been part of national and state life. The essence, formulation, and implementation of Pancasila Democracy have weakened. This weakening aligns with the perceived shift in Pancasila's role and status as the state foundation. The attitudes, actions, and activities of state and government administration often do not align with the consciousness of Pancasila as the state’s cornerstone. While Pancasila Democracy is a principle of Indonesian Constitutional Law, the development and practice of constitutional law in Indonesia no longer seem to be grounded in Pancasila Democracy. This article delves into the principles of Indonesian Constitutional Law within the framework of Pancasila Democracy, elucidating its meaning, formulation, and core essence.

Democracy is a system where the government should prioritize the people’s aspiration in implementing the policies because the people are a source of the power itself. A good Election system is a key of a good democracy system. This article is a research result of the citizenship validation in a government election. In fact, the citizenship validation mechanism is still not available in Indonesia as some violation cases happened during the Regent Election 2020 in Sabu Raijua. This research uses qualitative method and reference study analysist approach to deeply analyze the implementation of the citizenship validation during the general election in Indonesia. In addition, the theory of system and the concept of the democracy will be also used as an analysist so that it can give some descriptions and considerations to improve the quality of the next general election in Indonesia. The citizenship validation process also can be applied in other government administration affairs to support a better democracy implementation in the future.

Objective: Globalization has a great influence on the legal system of a country, including the mining legal system. In Indonesia, Pancasila can be considered the legal basis and the source of all laws. This study aims to analyze Pancasila as a Source of Law to answer the Challenges of Globalization related to Mineral and Coal Mining Laws in Indonesia. Method: The research method used is doctrinal law. The Statute Approach examines all laws and regulations relating to legal matter. Data was collected by studying literature and conducting direct interviews with informants. Result: Generally, the legal development of mineral and coal mining in Indonesia is based on Pancasila. Mining activities must be distinct from foreign investment activities. Regarding investment, the principles of international foreign investment conventions are not under Pancasila. Conclusion: Pancasila, as the nation's basic philosophy, is open without the need to change its fundamental values to be maintained following existing developments. Thus, even though Pancasila may not be in harmony with the legal principles of international investment, as long as the executive, legislative and judicial institutions are based on Pancasila in carrying out their duties, then in the future other ideologies cannot influence Pancasila ideology.

This research aims to explain process of developing the Indonesian nation in this global era requires a strong economic system so that the general welfare of the people can be realized following the state objectives listed in the Fourth Paragraph of the Preamble of the 1945 Constitution. To realize these state objectives are further regulated in Article 33 of the 1945 Constitution (Post Amendment). Article 33 of the 1945 Constitution provides a foundation for building and developing the Indonesian economy. Apart from that, it can also be used as a filter by the government and the people of Indonesia in dealing with the negative impacts of the development of liberalization in the world economy in the 21st century. However, the Indonesian economic system which is based on Article 33 of the 1945 Constitution, at the level of implementation regulated by law, is not in line with the goals of the state and the interpretation of Article 33 of the Constitution itself, in the end, it is often not achieved in building and realizing an Indonesian economy that can realize people's welfare or people's prosperity. This is because the legal politics of the legislators wrongly designed the implementation of legal products in the Indonesian economic system which is based on a family economy called cooperatives which is difficult to materialize and is only for certain interests.

Globalisasi merupakan fenomena yang telah berdampak besar, khususnya telah berdampak negatif terhadap kalangan kaum muda di Indonesia. Oleh karena itu, agama Islam sebagai agama yang mengajarkan moralitas kehidupan tentu memiliki sudut pandang dalam menganalisis dampak negatif globalisasi. Artikel ini menjelaskan bagaimana respon Islam terhadap globalisasi khususnya terhadap pemuda muslim di Indonesia. Metode penulisan artikel ini adalah studi kepustakaan (literature review). Artikel ini berargumen bahwa perkembangan pengetahuan dan teknologi harus selaras dengan ajaran agama agar para pemuda muslim mampu menyeimbangkan serta membedakan antara yang hak dan yang batil. Oleh karena itu, pemuda muslim selain menerima arus globalisasi tetapi juga harus memperkuat ajaran agamanya sehingga mampu membekali diri dengan akhlak yang luhur dan juga pengamalan ajaran agama yang baik.

The application of legal theory as a tool to achieve social goals can be seen through various policies designed to support universal access. Penerapan sistem demokrasi memiliki peran penting dalam menjaga persatuan, memelihara konstitusi, dan mengintegrasikan pendidikan politik dalam masyarakat. Artikel ini mengeksplorasi bagaimana demokrasi dapat menjadi alat efektif untuk memperkuat persatuan dan kepatuhan terhadap konstitusi suatu negara. Dengan menganalisis berbagai studi kasus dan teori politik, kami menyoroti mekanisme partisipasi publik dalam pengambilan keputusan, yang memberikan landasan bagi rasa memiliki dan tanggung jawab kolektif warga negara. Pemilihan umum yang bebas dan adil, kebebasan berpendapat, serta perlindungan hak asasi manusia adalah elemen penting dalam memperkuat stabilitas politik dan sosial, sambil memperluas cakupan pendidikan politik di masyarakat. Penegakan hukum yang konsisten dan adil adalah pilar penting dalam mencegah penyalahgunaan kekuasaan dan korupsi, sementara pendidikan hukum memberikan pemahaman yang lebih baik tentang konstitusi dan aturan hukum. Dengan menggabungkan pendidikan sebagai bagian integral dari proses demokratis, artikel ini menyoroti pentingnya komitmen terhadap prinsip-prinsip demokrasi dan kinerja institusi hukum yang independen untuk mencapai keberhasilan dalam mewujudkan persatuan nasional, keutuhan konstitusi, dan penegakan hukum yang efektif.

Desa Pancasila is one the models to mainstream Pancasila as the national value of Indonesia. The research aimed to describe and analyze Desa Pancasila as a strategy to implement Pancasila at village level. The research design used a qualitative descriptive and literature review. Data were collected through observation, interviews, documentation, and literature review. The results showed that the community’s potential with the diversity of natural resources, human resources and cultural resources could support the implementation of Pancasila national values. Local actors (local government, community leaders, and youth groups) have a significant role in implementing national values. The collaboration of local actors is in-depth dialogue, sharing vision, building trust, building commitment, and sharing knowledge. The obstacles occurred because of the globalization process and the lack of community participation. We argue that three possible solutions to overcome these problems: (1) to put the community leaders as facilitators to implement the national values; (2) to build awareness of the communities about the nation and state through joint movements to build national insight; and (3) to make a regular interactive dialogue between local leaders and the community related to the implementation of national values.

In recent times, the public has concerns addressed to the position of notary due to cases of violations of law and code of ethics by notaries. This situation leads to a question on the internalization of state values and ethical principles by a notary. This paper aims at elaborating on the position of a Notary in the Indonesian legal system, and further, analyzing the reflection of Pancasila values in Law on Notary and the Code of ethics of Notary. It is legal research that primarily analyzes the normative contents of applicable Indonesian law and regulations that regulate the issue of a notary, Articles of Association of the Indonesian Notary Association, Code of Ethics of Notary, as well as relevant court decisions. This article concludes that the Indonesian legal system granted notary a status as a public official authorized to make authentic deeds and other authorities as intended in Indonesian Notary Law. In addition, the legal system also requires notary, as a legal profession, to become a member of Ikatan Notaris Indonesia (INI), the only legitimate notary association in Indonesia. Normatively, both Indonesian Notary Law and the Code of Ethics of Notary have adopted the values contained in the precepts of Pancasila which in general require a notary to have good moral integrity, character, and personality; uphold professional ethics; prioritize services for the interests of the community and the state; have social concerns; and carry out tasks without merely focused on economic benefits.
