Abstract

Ces dernières années, plusieurs débats ont eu lieu entre les juristes internationalistes, d’une part, et les historiens et historiens du droit, d’autre part, sur la façon (« comment ») et les raisons (« pourquoi ») d’écrire l’histoire du droit international. L’objectif de cet article est de participer à ces débats au travers d’un cas d’étude : celui de l’abolition de l’esclavage et son inscription dans l’historiographie du droit international. Il s’avère en effet que l’histoire de l’esclavage et en particulier celle de son abolition a suscité un regain d’intérêt au sein de la discipline du droit international. Certains se sont tournés vers l’histoire afin de tirer des leçons du succès avec lequel le droit international aurait aboli la traite négrière transatlantique au xixe siècle. D’autres ont examiné l’histoire de la codification de l’esclavage en droit international au regard de l’impérialisme colonial européen. Il ressortira de notre analyse que le regain d’intérêt des juristes internationalistes pour l’histoire de l’esclavage est ancré dans le présent, au sens où ils veulent mieux comprendre le passé pour mieux agir dans le présent. Ce présentisme n’est pas un problème en soi ; il le devient lorsque le recours à l’histoire cesse d’être critique et sert simplement à justifier – et ainsi à pérenniser – les projets professionnels et les institutions existantes.

Das Buch erzählt von den paradoxen Anfängen des Völkerrechts im 19. Jahrhundert und von den zweideutigen Beziehungen, die es zum europäischen Kolonialismus unterhielt. Im ideellen Rahmen einer weiterhin einheitlich gedachten internationalen Rechtsordnung suspendierte der Westen die Anwendung des Völkerrechts Asien und Afrika gegenüber und vertraute auf das Konsular- und Kolonialrecht. Die neue juristische Wissenschaft stellte sich selbst als historisch, christlich, systematisch und positiv dar. Sie erhob sich zur Maßeinheit der zivilisierten Welt und machte aufgrund ihrer christlichen Wurzeln eine universale Berufung geltend. Dies sollte die Grenzen des Abendlandes überwinden und die Unterschiede zwischen uns und den anderen ausgleichen – und produzierte diese zwangsläufig selbst.

International Institutions Today: An Imperial Global State in the Making

The article argues that a growing network of international institutions — economic, social, and political — constitute a nascent global state, whose current task is to realize the interests of an emerging transnational capitalist class in the international system to the disadvantage of subaltern classes in the third and first worlds. The evolving global state formation can therefore be described as having an imperial character. Underpinning the emerging imperial global state is a web of sub-national authorities and spaces that represent, along with non-governmental organizations, its decentralized face. These developments, it is contended, seriously undermine substantive democracy at both inter-state and intra-state levels. Eight possible objections to the thesis that a nascent global state having an imperial character has evolved are next considered and rejected. The concluding section briefly explores the question as to whether international institutions can be reformed, the vision that should inform change, and some concrete proposals in this regard. It argues the case for a complex internationalism in which statist reforms are necessary in the short and medium terms. These reforms can only be brought about by a powerful global social movement.

L'aversion de l'auteur de la Richesse des Nations à l'égard de l'esclavage ne fait guère de doute et se double d'une argumentation économique. Comme celle de ses successeurs, jusqu'à Ricardo, Mill, puis Cairnes, l'argumentation de Smith conduit à conclure à l'inefficacité de l'esclavage face à l'activité libre – salariat ou travail indépendant. Les raisons positives de son émergence et de sa persistance semblent alors d'autant plus obscures. La réponse avancée par Smith ne concerne pas les choix du travailleur libre ou asservi, mais ceux de son maître, qui arbitre entre le désir de la domination et celui du profit dans un contexte d'aversion face au risque d'une révolte des esclaves. En plaçant l'accent sur les conséquences patrimoniales de l'abolition de l'esclavage, il est ainsi conduit à minimiser l'influence des modifications des préférences des maîtres, de leur aversion face au risque, ou de la profitabilité des activités productives, en faveur de celle d'un contre-pouvoir, dont les intérêts convergent avec ceux des esclaves, et dont l'autorité permet que leur liberté leur soit progressivement restituée.

In this provocative and timely book, David Kennedy explores what can go awry when we put our humanitarian yearnings into action on a global scale--and what we can do in response. Rooted in Kennedy's own experience in numerous humanitarian efforts, the book examines campaigns for human rights, refugee protection, economic development, and for humanitarian limits to the conduct of war. It takes us from the jails of Uruguay to the corridors of the United Nations, from the founding of a non-governmental organization dedicated to the liberation of East Timor to work aboard an aircraft carrier in the Persian Gulf. Kennedy shares the satisfactions of international humanitarian engagement--but also the disappointments of a faith betrayed. With humanitarianism's new power comes knowledge that even the most well-intentioned projects can create as many problems as they solve. Kennedy develops a checklist of the unforeseen consequences, blind spots, and biases of humanitarian work--from focusing too much on rules and too little on results to the ambiguities of waging war in the name of human rights. He explores the mix of altruism, self-doubt, self-congratulation, and simple disorientation that accompany efforts to bring humanitarian commitments to foreign settings. Writing for all those who wish that "globalization" could be more humane, Kennedy urges us to think and work more pragmatically.

The Old Regime and the Haitian Revolution

The Haitian Revolution (1789-1804) was an epochal event that galvanized slaves and terrified planters throughout the Atlantic world. Rather than view this tumultuous period solely as a radical rupture with slavery, Malick W. Ghachem’s innovative and critically acclaimed study shows that emancipation in Haiti was also a long-term product of its colonial legal history. The key to this interpretation lies in the Code Noir, the law that regulated master-slave relations in the French empire. The Code’s rules for the freeing and punishment of slaves were at the center of intense eighteenth-century debates over the threats that masters – not just freedmen and slaves – posed to the plantation order. "The Old Regime and the Haitian Revolution" takes us deep into this volatile colonial past, digging beyond the letter of the law and vividly reenacting such episodes as the extraordinary prosecution of a master for torturing and killing his slaves. Ghachem brings us face to face with the revolutionary invocation of Old Regime law by administrators seeking stability, but also by free people of color and slaves demanding citizenship and an end to brutality. The result is a subtle yet dramatic portrait of the strategic stakes of colonial governance in the land that would become Haiti.
