This presentation reflects the serious difficulties faced by citizens who must protect fundamental rights in court by revealing the misdeeds committed by civil servants and institutional corruption. The 126 slides constituting this report gather data that should facilitate the in-depth study of the problems disturbing the administrative and judicial organization of the State of Quebec. It is hoped that this research data will stimulate the discovery of solutions compatible with jus cogens to remedy the problem.

In first chapter is examined the jurisprudence that in the last twenty years has faced such problematic, and defined the judgment of opposition sometimes like new and independent judgment regarding the injunction of the judge; other times like phase of “horizontal” continuation of a process that is carried out in two sub-procedures; at last sometimes still continuing in a pattern of "vertical" in the manner of an appeal. In the second and third chapter, the examination of this theme is developed in a comparative perspective, and proceed to an analysis on the regulation developed by the doctrine, the exposure of different theories and their critics. In the fourth chapter sets out some issues for which the definition depends on the definition of proceedings on the opposition that is better use, so for example the problems associated with the identification of the jurisdiction of appellate court proceedings and the possible extinction of the opposition.

Procedural Due Process and Predictable Punitive Damage Awards

In Exxon Shipping Co. v. Baker, the Supreme Court’s most recent opinion on punitive damage awards, the Court declared that the real problem with punitive damage awards is their “stark unpredictability.” The Court abandoned all hope that common law jury instructions could produce predictable punitive damage awards. Instead, the Court suggested pegging punitive damage awards to compensatory damage ... [Show full abstract] awards. So far, analysis of the opinion has been minimal, likely due to the purported maritime law basis of the holding. Exxon should not be overlooked, however, as it signals a resurgence of procedural due process as a basis for challenging punitive damage awards — a type of challenge the Court has not heard since the early 1990s. Predictability of the amount is no different than fair notice of the likely severity of an award, which procedural due process requires. If common law jury instructions cannot produce predictable punitive damage awards, they also cannot produce awards consistent with the notice procedural due process requires. The Court’s Exxon pegging solution will not produce predictable awards (and ones that comply with procedural due process) because it relies on compensatory damages, which are inherently unpredictable. As an alternative, this Article suggests looking to restitution, a non-controversial punitive, civil remedy. Basing punitive damages on the defendant’s gain would produce predictable awards—as procedural due process requires.

IAALS hopes that information about this particular innovation will be helpful to decisionmakers, in Colorado and elsewhere, who are committed to improving the legal process.This report follows a preliminary report released in April of 2014. Since that time, more cases within the study sample have resolved, and the results in this Final Report have been adjusted to reflect the inclusion of these new data, as well as additional analyses conducted. The overall conclusions remain substantially unchanged.
