Abstract

Kebijakan otonomi daerah di Indonesia yang berjalan sejak kemerdekaan Indonesia, banyak mengalami perubahan paradigma. Paradigma pelimpahan urusan pemerintahan yang tepat diterapkan di Indonesia, masih belum menemukan posisi yang tepat. Tarik menarik urusan pemerintahan antara pusat dan daerah banyak ditentukan oleh kepentingan politik. Belum nyamannya posisi “bandul otonomi daerah” menandakan bahwa belum sepakatnya para ahli mengenai kebijakan desentralisasi di Indonesia. Belum terbentuknya paradigma yang dianggap tepat, tentunya dapat menganggu perkembangan daerah-daerah di Indonesia, dan hal ini juga dapat berpengaruh pada perkembangan Negara Kesatuan Republik Indonesia secara menyeluruh. Dapat dipahami bahwa memang tidak ada sesuatu yang sempurna dari kebijakan yang dibuat suatu rezim pemerintahan, namun setidaknya diperlukan pemikiran bersama dari para cendikia untuk perkembangan daerah-darah di Indonesia, sehingga diperlukan kebijakan otonomi daerah yang dapat dilengkapi dengan kebijakan turunannya dengan cepat sehingga pemerintah daerah dapat menerapkannya dengan baik. Tentunya pula diperlukan dukungan dari para cendikia untuk memberikan solusi permasalahan dalam penerapan otonomi daerah. Terlepas dari perbedaan pendapat mengenai paradigma kebijakan otonomi daerah tersebut, kebijakan tersebut harus tetap dilaksanakan sebagai penerapan hasil kesepakatan kepentingan politik di masa kini, maka dari itu buku dengan judul Handbook Pemerintahan Daerah ini memperjelas kebijakan otonomi daerah, hubungan pemerintahan pusat dan daerah, penerapan Undang-Undang Nomor 23 Tahun 2014 tentang pemerintahan daerah, berserta sejarah pemerintahan daerah.

This article discusses the policies of the targeted city local government related to Covid-19 regulations as well as policies issued by the government down to the regional level. The aim is simply to provide an overview of the situation in the areas affected by the disaster after the existence of local legal policies issued by the government in the research location. The research method used in this article is normative legal research. The results of this study describe the implementation of policies in efforts to deal with Covid-19 in Government regulations at the regional level, especially Makassar City which aims to prevent transmission of Covid-19. The implementation of local government regulations has made people aware of the importance of wearing masks, one of which is contained in the contents of the health protocol rules. The existence of policies issued by regulations is not yet an antidote to the Covid-19 virus, but this policy only prevents the spawning of Covid-19. The Covid-19 Task Force is tasked with assisting control and law enforcement against health protocol violations. The team was formed to carry out direct handling in the field in controlling and enforcing health protocol laws, especially in the Makassar City area. In order to reduce the transmission of the spread of the Covid-19 virus, the government should have policies that support each other so that it is more stringent in security and supervision during the implementation of the PSBB and it is hoped that it will patrol places more often that invite people to crowded places.

As a legal state, Indonesia's foundation for law formation is intricately connected with legal politics. Legal politics play a crucial role in shaping legislative regulations in Indonesia. Legislative regulations serve as the primary method for creating laws and form an essential element within the national legal system of Indonesia. The research method employed is qualitative research, specifically a literature review. The findings of this research underscore the necessity for guidelines in the process of legislating to create laws that safeguard the population, ensure fair treatment, and protect citizens' rights. Consequently, the legal politics of legislative regulation formation represent a political policy aimed at establishing universally applicable legal rules with the objective of strengthening the sustained development of legislative regulations. These legislative regulations can also take the form of regional regulations, which, too, originate from a process of legal politics. Abstrak. Sebagai negara hukum, Indonesia memiliki dasar pembentukan hukum yang tidak lepas dari politik hukum. politik hukum mempunyai peran yang sangat penting dalam pembentukan peraturan perundang-undangan di Indonesia. Peraturan perundang-undangan adalah metode utama dalam pembentukan hukum dan merupakan elemen inti dari sistem hukum nasional di Indonesia. Metode yang digunakan yaitu metode penelitian kualitatif dengan jenis penelitian studi kepustakaan (literature review). Hasil penelitian ini menunjukkan bahwa untuk menciptakan hukum yang dapat memberikan perlindungan kepada rakyat, memberikan perlakuan yang adil, dan menjamin hak-hak warga, diperlukan pedoman dalam proses penyusunan peraturan perundang-undangan. Oleh karena itu, politik hukum pembentukan peraturan perundang-undangan adalah suatu kebijakan politik yang diambil untuk menetapkan aturan hukum yang berlaku secara umum dengan tujuan memperkuat pembentukan peraturan perundang-undangan yang berkelanjutan. Adapun peraturan perundang-undangan tersebut dapat berupa peraturan daerah yang mana peraturan tersebut juga terbentuk dari suatu proses politik hukum.

This study aims to determine the Village Revenue and Expenditure Budget (APBDes) in Sukamukti Village, Pataruman District, Banjar City. The background of this research is the problem of the community not participating in village budget meetings, hoping that the village government can make outreach to people who don't know what APBDes is.This type of research uses a qualitative approach with a case study type. The data sources used in this approach are primary data sources and secondary data. Primary data sources were obtained through interviews and secondary data sources were obtained from books, the internet and related documents. Informants in this study were the Village Head, Village Secretary, Head of BPD, Community and Religious Leaders of Sukamukti Village.The results of this study are that the management of the APBDes in Sukamukti Village is based on the principle of transparency by placing billboards/transparency boards that contain items in the APBDes ranging from Income, Expenditures to Financing and the principle of accountability at the reporting stage. in accountability for managing village fund allocations. in accordance with existing provisions.

Salah satu fungsi kepala desa adalah menerapkan hukum sebagai sarana untuk mengendalikan dan memperbaharui masyarakat desa atau yang biasa disebut sebagai hakim perdamaian desa. Dalam penyelesaian sengketa warisan ini kepala desa biasanya tidak mengambil keputusan sendiri tetapi bersama para tokoh masyarakat, dan pamong desa lainnya ataupun sesepuh desa tersebut yang mengetahui riwayat dari antara ahli waris yang bersengketa tersebut dan harta peninggalan dari pewaris agar keputusan yang diambil dapat ditaati oleh para pihak dan tidak melenceng dari adat kebiasaan yang hidup di daerah tersebut. This study aims to determine and analyze the Organizational Development of the Regional Leadership Coordination Forum in supporting the implementation of the duties and functions of administering general government affairs, to identify and analyze the supporting and inhibiting factors for the Organizational Development of the Regional Leadership Coordination Forum in supporting the implementation of the duties and functions of implementing general government affairs, to identify and analyze efforts to overcome the inhibiting factors for Regional Leadership Coordination Forum Organizational Development in supporting the implementation of the duties and functions of implementing General Government Affairs in Bolaang Mongondow Regency, North Sulawesi Province. This research is a qualitative research using an inductive approach. The research method used in the form of observation, documentation and interviews. Based on the results of field analysis, it can be concluded that development has not yet occurred in the Bolaang Mongondow Regency Regional Leadership Coordination Forum, North Sulawesi Province, but the implementation of the duties and functions of implementing general government affairs is still being carried out. In the development process, the existing inhibiting factors are not a problem in the Organizational Development of the Regional Leadership Coordination Forum in Bolaang Mongondow Regency.

The COVID-19 pandemic has resulted in demands for the provision of public services by minimizing face-to-face services. BKIPM Semarang in its efforts to provide good public services to the community continues to strive for innovation. One of the innovations created by BKIPM is the KAU DARANG (Fish Quarantine is for You Now) innovation. This innovation is a public service innovation where people can get a certificate of fishery quality in physical form without having to come to the BKIPM Semarang office because the certificate will be sent to their respective homes even for people whose homes are difficult to reach. The purpose of writing this article is to analyze how the process of the innovation is because the innovation is new and has never been studied before. The research method used in this study is a descriptive qualitative method with library research data collection techniques. The results of the study indicate that this innovation is a process innovation that is reinforcing or reinforcing in nature, which seeks to improve previous innovations because previous innovations only facilitated the delivery of certificates to producers which only covered certain areas. With this innovation, people do not need to crowd at UPT BKIPM Semarang to get a certificate according to their needs, but only need to submit an application online for processing and then wait for the certificate to come to their house.

The Aceh Special Autonomy Fund, better known as DOKA, was established in 2008. The amount of DOKA increases significantly every year. However, the increase was not followed by an increase in the local economy. As such, there was no significant improvement in the welfare of the people of Aceh. Therefore, this paper seeks to examine the Aceh Special Autonomy Fund’s Management Model. This paper was using qualitative method through FGD, interviews, and documentation. The results of this study showed the need to improve the performance of the Asymmetric Decentralization Policy through Special Autonomy in Aceh Government such as 1) completion of the drafting of implementing regulations; 2) establish a proactive communication and build trust; 3) socialization by the Ministry of Home Affairs related to the Law on Aceh Government (UUPA) in relation to the Law on Oil and Gas, free trade and others; 4) drafting of guidelines in the implementation of special autonomy; 5) facilitates the division of authority between the Aceh Provincial Government and its district/city governments. The recommendation from this study is to list the division of authority of government affairs in detail between the Aceh Provincial Government and its district/city governments, by considering of the characteristics and aspirations of the regions to avoid disputes over authority and overlapping authority.

Allocation of Village Funds including Village Funds in its implementation is carried out by several regional government institutions, namely the first local government itself as the regulator or policy maker of use and utilization, secondly the sub-district government and related technical agencies that play a supervisory, mentoring and facilitator role and the third and final is the village government itself as the recipient, user and user of the fund. the implementation of village fund allocation policies in development in the village of Tatelu Rondor, Dimembe Subdistrict, North Minahasa Regency through physical development in the village did not work well, this condition was based on facts namely lack of proper and correct understanding of village government, unavailability of resources adequate in supporting the smooth implementation of village fund allocation policies, lack of communication in supporting implementation activities, lack of support from some village officials and the community, and bureaucratic structures often hampered.

As one of the regions in the Riau Archipelago Province, Lingga Regency has its potential in the agricultural sector, supporting local food needs to distribute the surrounding area. So far, food needs in Lingga are supplied from Jambi Province or other regions, so that the dependence on food from other regions is very high. So, if the weather changes every year, the supply of food needs will decrease, and prices will be higher. The solution, the production of subsistence farmers, can be used as an alternative to meet food needs. Therefore, local governments encourage subsistence agricultural productivity so that production results are utilized by providing subsidies for agricultural production facilities, supporting farming capital, strengthening farmer institutions, and providing rural transportation. Meanwhile, technology cannot increase productivity, considering that subsistence farmers still use traditional culture, so local farmers cannot use that modern agricultural technology. This study aims to determine how local governments encourage the productivity of subsistence farmers as suppliers of regional food needs. Then this research is qualitative with a study approach that examines the government's efforts to encourage subsistence agricultural production.

Dengan ditetapkan Undang-Undang Nomor 11 Tahun 2001 Tentang Pembentukan Kota Batu tanggal 21 Juni 2001, terbentuklah Kota Batu sebagai daerah otonom baru di Jawa Timur. Sesuai dengan kewenangannya Pemerintah Daerah Kota Batu menetapkan Visi Desa Berdaya Kota Berjaya ke dalam RPJMD Tahun 2017-2022. Penelitan ini mengambil rumusan masalah: Produk hukum daerah apa sajakah yang sudah dan/atau belum dibentuk oleh Pemerintah Daerah Kota Batu sebagai daerah otonom, guna mengatur lebih lanjut UU Desa dan aturan pelaksanaannya untuk mewujudkan Visi Desa Berdaya Kota Berjaya? Bagaimanakah implementasi Visi Desa Berdaya Kota Barjaya, serta produk hukum daerah apa sajakah yang berpengaruh terhadap tercapainya Visi Desa Berdaya Kota Berjaya? Hal ini perlu dikemukakan karena pembahasan tentang Desa tidak lepas dari bingkai regulasi yang mengatur tentang Desa (UU Desa dan Peraturan-Peraturan pelaksanaannya). Penelitian ini menggunakan pendekatan yuridis empiris. Penelitian yang berbasis pada inventarisasi hukum positif, penemuan asas-asas hukum dan penemuan hukum inconcretto, yang dilengkapi pengamatan operasionalisasi asas-asas hukum secara empiris. implementasi Visi desa Berdaya Kota Berjaya memerlukan komitmen untuk pengaturan lebih lanjut baik secara atributif maupun delegatif sesuai regulasi tentang desa dengan peraturan daerah maupun peraturan walikota. Hal ini menjadi niscaya, karena desa dalam kontek UU Desa sudah bukan lagi sebagai obyek, malainkan ditempatkan sebagai subyek pembangunan. Key word: Rural development, Approach in Border villages, Dilema Kondisi Perbatasan Desa menurut Undang-Undang No. 6 Tahun 2014 dapat disebut sebagai desa dan desa adat atau yang disebut dengan nama lain, selanjutnya disebut Desa, adalah kesatuan masyarakat hukum yang memiliki batas wilayah yang berwenang untuk mengatur dan mengurus urusan pemerintahan, kepentingan masyarakat setempat berdasarkan prakarsa masyarakat, hak asal usul, dan/atau hak tradisional yang diakui dan dihormati dalam sistem pemerintahan Negara Kesatuan Republik Indonesia. Pengertian desa tersebut dapat dimaknai dengan suatu kewenangan otonomi dalam berbagai aspek kehidupan berbangsa dan bermasyarakat di wilayah desa. Pembangunan dan pelaksanaan pemerintahan untuk mensejahterahkan masyarakat berawal dari tingkat wilayah pemerintahan terkecil yaitu desa dan kelurahan. Berdasarkan pendataan Potensi Desa (Podes) yang dilaksanakan 3 kali dalam 10 tahun oleh Badan Pusat Statistik (BPS) menunjukkan bahwa pada bulan April 2014 tercatat 82.190 wilayah administrasi pemerintahan setingkat desa yang terdiri dari 73.709 desa , 8.412 kelurahan pada 7.074 kecamatan. Hal tersebut menandakan bahwa pelaksanaan pemerintahan pada tingkat desa dan kelurahan perlu ditata dengan baik sehingga dapat melaksanakan urusan otonomi desanya dengan baik. Berdasarkan Podes 2014 juga teridentifikasi sebanyak 256 desa/kelurahan berbatasan langsung darat dengan wilayah negara lain (desa/kelurahan terdepan), yaitu 60 desa/kelurahan di Nusa Tenggara Timur, 65 desa di Kalimantan Barat, 1 desa di Kalimantan Timur, 81 desa di Kalimantan Utara, dan 49 desa di Papua. Developing the Nationalism for the Youth in the National Borders through Out of School Educational Program. The study is aimed at determining the socio-economic problems, their cause and effect on their nationalism, and developing an out of school training program to improve the nationalism of the youth in national borders. The research method used in this study is qualitative analysis. The result indicates that the people in the remote areas are poor because of limited infrastructure, health care, and educational services which result in the migration, human trafficking, smuggling, and the nationalism crisis. The study also indicates that the out of school educational program can be effective if the educators guide the learners as the next generation to continue developing the country and train them to have a writing habit to accelerate their educational levels. Abstrak: Pembinaan Nasionalisme Pemuda Perbatasan melalui Program Pendidikan Luar Sekolah. Penelitian ini bertujuan mengetahui permasalahan sosio-ekonomi, berikut penyebab dan pengaruhnya terhadap nasionalisme, dan mengembangkan model pembinaan nasionalisme bagi para pemuda daerah perbatasan negara melalui program pendidikan luar sekolah (PLS). Metode yang digunakan dalam penelitian ini adalah analisis kualitatif. Dari penelitian ini diketahui bahwa masyarakat daerah perbatasan negara banyak yang miskin karena terbatasnya infrastruktur, layanan kesehatan, dan layanan pendidikan sehingga terjadi migrasi, perdagangan manusia, penyelundupan, serta krisis nasionalisme. Program PLS ini mendorong ter­jalinnya kerjasama antar berbagai pihak, brainstorming untuk menemukan krisis nasionalisme dan penye­babnya, focussed group discussion untuk menemukan jalan keluarnya, serta pelibatan warga belajar untuk mengevaluasinya. Hasilnya menunjukkan bahwa program ini bisa efektif jika para pendidik membimbing warga belajar sebagai kader penerus perjuangan bangsa; dan warga belajar membiasakan diri menulis untuk mempercepat mereka menjadi cerdas.

This paper examined the fundamental problems that envelope local government administration in Edo State, and discovered that the challenges are constitutional issues. It also identified problems of graft, poor revenue generation by local authorities, and poor revenue allocation cum fiscal transfer to local governments. Besides, the paper identified erosion of fiscal autonomy and failure of local governments to be responsible for their inability to impact positively on the citizenry. Primarily, information was sourced through the interviews of purposively selected Local Government Officials of Edo State origin, while secondary information was collected through the instrumentality of official publications, records of political associations; relevant books, journals as well as Edo State Local Government Law (2000) and the Federal Republic of Nigeria Constitution of 1999. To stimulate harmonious Inter Governmental Relation (IGR), the Presidency should set up Advisory Commission on Inter governmental relations (ACIR) to be located at the Presidency with any arm of it in the State and Local Government levels, and there should be the complete re-orientation and selfpurgation of the rank and file of Local Government functionaries in order to promote high degree of transparency, probity, responsiveness and accountability. Also, some degree of autonomy in operations and resources for local governments should be guaranteed. It is expedient to amend the 1999 constitution to remove the preposterous super-ordinate/subordinate pattern of relationship between state and Local Governments. In addition, many governments and development agencies have devoted substantial resources and energies to fighting corruption in recent years. Even so, it is not yet clear that the incidence of corruption has declined perceptibly, especially in highly corrupt countries. This article argues that the lack of significant progress can be attributed to the fact that many programs are simply folk remedies or one-size-fits-all approaches and offer little chance of success. For programs to work, they must identify the type of corruption they are targeting and tackle the underlying, country-specific causes, or "drivers," of dysfunctional governance.

Decentralized government institutions are doing more of the work of government than ever before, but there is little agreement about 1) what decentralization means, or 2) how it should be measured. To overcome this confusion, this article builds on standard definitions of decentralization that include three core dimensions: fiscal, administrative, and political. The article offers an empirical test of that definition using factor analysis of data from 1996 for sixty-eight countries. Factor analysis confirms these three core dimensions and generates a score for each case in each dimension, allowing countries to be measured according to their type and degree of decentralization. In future work, these scores can be used for hypothesis testing about the causes and effects of decentralization on important social outcomes. This exercise demonstrates that conceptual confusion need not hamper research when empirical tests can help verify conceptual categories.

Understanding sources of sustained competitive advantage has become a major area of research in strategic management. Building on the assumptions that strategic resources are heterogeneously distributed across firms and that these differences are stable over time, this article examines the link between firm resources and sustained competitive advantage. Four empirical indicators of the potential of firm resources to generate sustained competitive advantage-value, rareness, imitability, and substitutability are discussed. The model is applied by analyzing the potential of several firm resources for generating sustained competitive advantages. The article concludes by examining implications of this firm resource model of sustained competitive advantage for other business disciplines.
