Bouncebacks! Medical and Legal is a thought-provoking book engaging a synoptic view of the intersection between law and medicine. The practice of law and the practice of medicine are inextricably intertwined; still, their respective methods of analysis suffer from a logical disconnect. The medical world uses retrospective review of care for the purpose of quality improvement—ie, to learn from prior outcomes and improve care in the future. Legal analysis seeks to evaluate the root cause of a problem, not for the purpose of quality improvement, but to redress perceived wrongs that have befallen the patient. Bouncebacks! addresses this issue head on through analysis of emergency department case studies.

The purpose of this study is to analyze the legislative and jurisprudential setting of the civil liability of judges and magistrates resulting from inexcusable ignorance, as well as judicial error, as structural parts necessary to understand the legal liability system established by the legislature. Our study leads us to prove the factual ineffectiveness of both institutions and, consequently, to propose a solution to end a situation of some judicial civil immunity repeatedly denounced by the specialized legal doctrine.

They suffer from the solo status that accompanies being a member of an underrepresented group, the stereotype threat that accompanies being a member of a stereotyped group, and the challenges that attend lacking a background in the law before beginning law school. [Show full abstract] foundational content and skills, or take basic steps toward providing instruction that ensures students from all backgrounds are empowered to thrive. While much has been written about improving legal education and about the failure of current pedagogies to provide a sound education to students experiencing this triple-threat, little has been written about approaches that ensure that these students succeed. This article is an attempt to identify an initial pathway forward. It builds off of research regarding legal pedagogy, inclusive pedagogy, and the results of eleven in-depth-interviews with “transformative professors” who UC Berkeley Law students identified as being skilled at creating safe spaces and ensuring that individuals from all backgrounds succeed academically. This rich data can inform professors and institutions across the state and country in their efforts to provide a legal education that, instead of simply benefiting the most privileged, provides a transformative education to all.We have used the term “safe” to describe techniques and environments that allay stereotype threat and solo status and allow students from underrepresented backgrounds to focus on learning.

Two Worlds Collide: How the Supreme Court's Recent Punitive Damages Decisions Affect Class Actions

This article examines the intersection between two controversial areas of the law - punitive damages and class actions - and argues that the Supreme Court's recent jurisprudence clarifying the due process limits on punitive damages has broad implications on the procedural laws governing the types of cases that can properly be certified as a class action. Specifically, the article discusses the ... [Show full abstract] Supreme Court's evolving approach to punitive damages from one that considered the harm a defendant's conduct caused to society as a whole to one that now focuses almost exclusively on the harm to the specific individual bringing the lawsuit. This shift, which recently culminated in the Court's 2007 decision in Philip Morris USA v. Williams, constitutionally requires that the amount of a punitive damages award relate to the amount of harm suffered by the party bringing the suit. That requirement is at odds with class action practices that treat punitive damages as a common, class-wide issue and that have allowed juries to assess a punitive damages award before evaluating the harm to the individual class members. The article argues, therefore, that where injuries are not uniform among class members, punitive damages cannot be pursued as a class-wide remedy.

While these approaches stress the literary qualities of rabbinic literature, as Cohen notes, they treat the subunits in isolation and consequently ignore the meaning conferred upon them by their broader contexts.
