Abstract

Rada¯'ah (sucking) is one of the basic rights of the child. In the Islamic law according to one opinion it is a religious duty of a mother to breastfeed her child whereas according to others it is just a recommendation. Pakistani law recognizes this right but takes the approach that it cannot be judicially enforced. In the Islamic and Pakistani law suckling is important as it creates a prohibited degree of relationship between the parties. The article aims to discuss the concept and the rules regarding suckling in the Islamic law. Relevant legislation in the Pakistan will be discussed to see Pakistan's stand on the issue. Important cases are discussed to consider the approach of the courts in deciding issues regarding suckling. The article deals with the Sunni' view due to it being the law that the majority of Pakistani Muslims follow.
