Right to Information and Itts Significance to Ensure Good Governance in India

Abstract

The free flow of information is must for a democratic society as it helps the society to grow and to retain a continuous debate and discussion among the people. No democratic government can survive without accountability and the basic postulate of accountability that is the people should have information about the functioning of the government. Gone are the days when public dealings were kept in strict secret, a practice which often led to corruption, misuse and abuse of statutory and administrative power. Freedom of information brings openness in the administration which helps to promote transparency in state affairs, keep government more accountable and ultimately reduce corruption. Disclosure of information in regard to the functioning of the government must be the rule and secrecy an exception. The Right to Information Act, 2005 was passed for making the government transparent and more accountable; the effective use of it would, in a long run, curb corruption. In a responsible Government like ours where all the agents of the public must be responsible for their conduct, there could be no secrets. There has been no vehicle available for individual citizens to impact the governance structure. In a system reeking with corruption and becoming increasingly insensitive to the problems of the disadvantaged Citizenry, the Right to Information has shown promise of empowering Citizens to get accountability and act as an enforcer of good governance.

This study aims to describe and analyze the implementation of the public information disclosure (PID) practices at the local governmental level. It was carried out in two municipalities in Central Java Province, namely, Magelang and Semarang Cities. The results of the study found many different outcomes in practicing PID in both cities. Compared to Semarang City, Magelang City is still lagging in infrastructure, system of technology and readiness of human resources in the area of information disclosure. The study revealed that PID tends to influence the commitment of local government official to be transparent, as the authority holder in providing information. In the Semarang City case, the local leader and his public officials are seriously handling this policy. The strong willingness of the local leader leads to implement of the regulation, establish proper infrastructure and provide skilled officers. As the result, local government administration is likely to be more accountable, transparent and thereby achieved higher public trust. The lesson learned is the more willing local leaders implement public information disclosure, the more accountable the local government becomes.

Kashmir, India's highest point is 566 kilometres away from the capital city of New Delhi. Visitors to this region, which is bordered by the Himalayan and Pir Panjal ranges, marvel at the breath-taking scenery. The RTI Act was implemented by the state government as a mechanism for resolving administrative complaints. Knowing that corruption can be a deadly disease, Indian-controlled Jammu and Kashmir state has taken steps to ensure citizens have access to reliable, up-to-date information about their government. This has been used a lot by citizens and the media to find out about corruption, government work, and how much money the state of Jammu and Kashmir spends. This is done to make sure that the state is transparent and has good governance. State law has changed since Article 370 was repealed. The Central RTI Act 2005 now rules in the state after that law was changed. This paper takes a gander at the adequacy of the right to information act in Jammu and Kashmir to check whether there is any defilement nearby. As the paper shows, the RTI Act has been truly adept at lessening contrasts in admittance to data and looking into corruption. The individuals who work for the public authority have become more responsive and responsible since the RTI Act was passed into regulation.

This research examines the extent of empowerment of citizens after the enactment of the act; to identify the barriers that inhibits the free flow of information; to explore how right to information contributes to good governance; and to suggest the improvement areas of RTI implementation to strengthen the good governance.
