Comment faire face au trafic d’organes ? Le point de vue du Declaration of Istanbul Custodian Group (How to address organ trafficking? The point of view of the Declaration of Istanbul Custodian Group)

Abstract

Le Declaration of Istanbul Custodian Group (DICG) a été formé en 2010 pour promouvoir les principes de la Declaration of Istanbul on Organ Trafficking and Transplant Tourism, et favoriser le transfert de ses préconisations dans les lois et les habitudes professionnelles dans le monde entier. Cette mise au point résume les principes de la Déclaration, et les multiples rôles que doivent jouer les professionnels de santé dans la lutte contre le trafic d’organes et le “tourisme de transplantation”. La mondialisation du commerce et des échanges rend de plus en plus complexe cette lutte. Les professionnels de santé sont en première ligne et ont la responsabilité d’identifier et développer de nouvelles solutions dans cette lutte sans cesse renouvelée. The Declaration of Istanbul Custodian Group (DICG) was established in 2010 to promote the principles of the Declaration of Istanbul on Organ Trafficking and Transplant Tourism, and to encourage and assist in their implementation in policy and practice throughout the world. In this paper, I review the work undertaken by the DICG and discuss the important and multifaceted role that health professionals must play in efforts to combat organ trafficking. The evolution of transplant “tourism” and the shifting dynamics of the international organ trade present complex challenges, and health professionals are well placed to identify and develop new solutions to these persisting problems.

... In addition to influencing legislation, the declaration may have significantly decreased activities within the organ trade [28,206]. Over the past several decades, over 100 countries have passed legislation banning commercial organ transplantation. What explains this rapid, global diffusion of laws? Based on qualitative data from in-depth interviews, historical analysis, and secondary sources, this paper explores the role played by the medical epistemic community and human rights in the global spread of laws against the organ trade. In addition to shaping, guiding, and influencing norms and approaches to transplantation, the epistemic community has been instrumental in the development of various resolutions, policy initiatives, recommended practices, statements, legislation, and model laws. Moreover, the epistemic community helped position the organ trade as an issue of societal and global importance, and it persistently encouraged states to undertake actions, such as implementing legislation, to combat the organ trade. Critically, the epistemic community's efforts against the organ trade incorporated the concepts of human rights, integrity, and dignity, which had diffused globally and become institutionalized in the period after WWII.

By 2005, human organ trafficking, commercialization, and transplant tourism had become a prominent and pervasive influence on transplantation therapy. The most common source of organs was impoverished people in India, Pakistan, Egypt, and the Philippines, deceased organ donors in Colombia, and executed prisoners in China. In response, in May 2008, The Transplantation Society and the International Society of Nephrology developed the Declaration of Istanbul on Organ Trafficking and Transplant Tourism consisting of a preamble, a set of principles, and a series of proposals. Promulgation of the Declaration of Istanbul and the formation of the Declaration of Istanbul Custodian Group to promote and uphold its principles have demonstrated that concerted, strategic, collaborative, and persistent actions by professionals can deliver tangible changes. Over the past 5 years, the Declaration of Istanbul Custodian Group organized and encouraged cooperation among professional bodies and relevant international, regional, and national governmental organizations, which has produced significant progress in combating organ trafficking and transplant tourism around the world. At a fifth anniversary meeting in Qatar in April 2013, the DICG took note of this progress and set forth in a Communiqué a number of specific activities and resolved to further engage groups from many sectors in working toward the Declaration's objectives.

Organ transplantation is widely practised worldwide. The expansion of organ transplantation has led to a critical shortage of organs and the development of the organ trade. Many patients travel to areas where organs are obtainable through commercial transactions. Although the international organ trade is regarded as an important health policy issue, its current state remains obscure because of scarce data and the lack of efforts to synthesize available data. This paper is an attempt to integrate information about the current international organ trade and create a tentative global picture based on a systematic review of 309 media reports, journal articles and other documents. The international organ trade is described in terms of its forms, the organ-exporting countries, the organ-importing countries and its outcomes and consequences.

Inspired by Sweetness and Power, in which Sidney Mintz traces the colonial and mercantilist routes of enslaving tastes and artificial needs, this paper maps a late‐20th‐century global trade in bodies, body parts, desires, and invented scarcities. Organ transplant takes place today in a transnational space with surgeons, patients, organ donors, recipients, brokers, and intermediaries—some with criminal connections—following new paths of capital and technology in the global economy. The stakes are high, for the technologies and practices of transplant surgery have demonstrated their power to reconceptualize the human body and the relations of body parts to the whole and to the person and of people and bodies to each other. The phenomenal spread of these technologies and the artificial needs, scarcities, and new commodities (i.e., fresh organs) that they inspire—especially within the context of a triumphant neoliberalism—raise many issues central to anthropology's concern with global dominations and local resistances, including the reordering of relations between individual bodies and the state, between gifts and commodities, between fact and rumor, and between medicine and magic in postmodernity.

Transplant tourism is spurred by the global shortage of organs and the potential for regulatory arbitrage in purchasing an organ in jurisdictions that do not prohibit sale or lack effective regulatory mechanisms to enforce prohibition. Various nations once identified as transplant tourism hotspots have since enacted legislation prohibiting organ sales and emplaced regulatory oversight. However, concerns persist that the legitimization of altruistic unrelated living donor transplants conceals underlying commercialism and unethical practices. These concerns are heightened when transplant candidates travel across borders in search of international transplant medicine. This article examines the regulatory challenges associated with differentiating international transplant medicine from transplant tourism, and various regulatory mechanisms that have been developed to address them from the domestic perspective -in particular, those recently implemented in the Singapore. It seeks to identify the strengths and weaknesses of the Singapore system and what lessons this has for international standards and practices.

Little is known about the mechanisms by which individuals may solicit or offer organs for transplantation on the internet, despite widespread recognition of the ethical concerns raised by online solicitation of unrelated living organ donors. In this paper, we present the preliminary findings of the Online Solicitation of Organ Donors (OSOD) study in the context of a multinational living donor online forum. Methods: A forum dedicated to communication between potential donors and recipients within an international online community website with a prohibition on commercial activity was analysed. Publicly presented personal information was extracted from all threads initiated during a six week period (1 June 2013 – 14 July 2013 inclusive). Openly posted names, usernames, email addresses and phone numbers were used to trace any further evidence of online activity elsewhere. Results: From a total of 45 individual user profiles identified, four user categories were defined: offerers (n=20); solicitors (n=20); brokers (n=1) and other (n=4). Approximately 89% of solicitors and offerers were concerned with obtaining or donating livers (n=18) and/or kidneys (n=22). Ten countries were identifiable with 36 of the user profiles; 29% were associated with the USA and 27% with India. Of the offerers, 50% were identified offering their organs in a variety of unrelated internet forums, with at least 7 of the 10 seeking monetary payment. Conclusion: Nominally altruistic organ donation online forums appear to provide a platform for individuals to solicit and offer organs across the world. Participation in such forums is one of the strategies prospective organ vendors, buyers and brokers may use to arrange sales. Greater knowledge of these online interactions will inform efforts to prevent harmful practices and assist in the evaluation of illicit organ trade in the international setting.

Commercial transplantation has expanded because of the shortage of kidneys for transplantation. This study aims to synthesize qualitative studies on the experiences and perspectives of living commercial kidney donors. We conducted a comprehensive literature search in electronic databases to April 2011 and consulted experts to identify unpublished studies. Thematic synthesis was used to analyze the findings. Seven studies involving over 676 commercial kidney donors were included. Three major themes were identified: desperation (the participants' decision to sell their kidney was forced by poverty, debt, or to fulfill a family obligation); despair (destroyed body integrity, shame and secrecy, dehumanized and dispirited, loss of livelihood, heightened sense of vulnerability, disappointment, and regret); and debasement (deception by brokers and recipients, victimized by the hospital, stigmatized by community, and rejected by family). Commercial kidney transplantation is reported to result in ramifications for the donors' mental, physical, and social well-being. Not only do they remain in poverty, they lose dignity, sense of purpose, respect, relationships, and livelihood. Review of this published literature supports the need for effective implementation of the WHO guiding principles and legislated regulation to deter potential recipients and healthcare providers from pursuing commercial transplantation.
