This article is essentially the story of the development, implementation, and testing of a treatment protocol designed specifically for rural individuals who are substance misusers. Although the treatment protocol that emerged from this process seemed to be valuable for clients, the researchers were not able to establish with statistical significance that it was better than conventional treatment. In some ways, this was a failure. This article explores some of the possible reasons why new treatment approaches, tested in real clinical situations, may have difficulty establishing their effectiveness. The factors involved are many and complex.

The research revealed a wide variation regarding the implementation of the TQL process and TQL training in the field contracting offices. In a majority of the field contracting offices, actual implementation has not yet reached the lowest levels. The research revealed that field contracting personnel view implementation of the TQL process as having a positive effect on improving the conduct of the contracting process.

Our interfaces establish design rules that govern how specific points in program execution are exposed through a given join point model and how conforming code on either side should behave. In a case study of the HyperCast overlay network mid- dleware system, including a real options analysis, we compare the widely cited oblivious design approach with our own, showing sig- nificant weaknesses in the former and benefits in the latter.

This study tested the ability of sixteen different electrical stimulation trains to produce repetitive lower leg movements through a fifty-degree target excursion. Five constant-frequency trains (CFTs), five variable-frequency trains (VFTs), five doublet frequency trains (DFTs) and a high-frequency (lOOHz) burst were tested. The results indicated that the DFT was the most successful train type, ... [Show full abstract] and that the high-frequency burst was the most successful train overall. The repetitive doublet activation offered by DFTs may have stimulated force augmentation mechanisms many times within a train, therefore improving performance in fatigued muscle. In addition, the success of the high-frequency burst may have been due to activation of the same mechanisms responsible for force augmentation as those triggered by doublets.

L'échantillonnage des trains d'impulsions, initialement un problème combinatoire, est contourné par une étape réversible de type « Metropolis-Hastings ». En explorant un sous-ensemble d'espace par itération, cette étape garantit l'irréductibilité de la chaîne. La méthode est validée sur les signaux EMG simulés par Farina et coll., pour lesquels on connaît les trains d'impulsions de chaque unité motrice. Par rapport à la décomposition effectuée par un opérateur expert sur les signaux expérimentaux à 5% et 10% de la force maximale de la contraction, la méthode a abouti à une précision de 89, 0 ± 1, 6%.

Investigation of the usage of key budget instruments– entitlements, multi-year appropriations, and tax expenditures – suggests that Congress has been more discriminating in its institutional choices than is commonly supposed. Sensitivity to the importance of transaction costs would increase the effectiveness of budget reforms.

Background and opinion data were gathered from cost panel members and other source selection personnel in order to assess the preparedness of source selection participants. The three major areas examined were source selection training, participants' preparedness, and problems encountered during source selection. ... [Show full abstract] The analysis was accomplished by sending a survey instrument to source selection personnel in six Air Force Systems Command product divisions. The results show that over eighty four percent of the cost panel members had never received any formal source selection training. Although the majority of the cost panel members felt prepared for their source selection responsibilities, over sixty percent felt additional cost analysis and source selection training would be beneficial. Finally, the results showed that there was no significant difference between the cost panel members' survey responses and those of the other source selection participants.

This is the first study to provide robust empirical foundations to a theoretical literature which so far had to assume behavioral adjustments in response to probation periods. Probation periods typically precede regular employment contracts and are commonly interpreted as a screening device for employers. During probation employees have an incentive to behave according to the expectations of ... [Show full abstract] employers, because in this time they can easily be laid off. Also, salaries are frequently renegotiated after probation periods. Thus it is hypothesized that "bad" workers attempt to mimick "good" workers during probation. The incentive for such mimicking behavior disappears as soon as the probation period terminates and the formal employment contract is signed. At the example of absenteeism we evaluate whether behaviors change after the end of the probation period. We investigate a sample of newly hired employees and find large jumps in the predicted probability of absences after probation periods are completed. For white collar and public sector employees this is confirmed in the coefficient estimates, and for public sector employees the predicted probability of a work absence is even significantly higher after the probation period is completed. These results confirm the hypothesis of behavioral effects of probation periods and are robust to various changes in estimation methods.

In this article I discuss the consequences of inducing someone to enter into an unconscionable contract and I suggest that there must be limitations on behavior associated with manipulative negotiation strategies. In addition, this article proposes that when inappropriate negotiation strategies result in an unconscionable term or agreement, there should be accountability if damages can be proven. ... [Show full abstract] Negotiation techniques and strategies are subject to scrutiny under the rubric of procedural unconscionability. Procedural unconscionability can be shown to have an impact on the sanctity of the contracting process. This article addresses the question of whether there is room in the law for a legal remedy for the consequences that may flow from procedural unconscionability. I propose a tort theory that I have named Consequential Procedural Unconscionability. The issues discussed are presented within the framework of a finding of unconscionability based on an unwarranted manipulation of cognitive biases or heuristics.

Once the pre-contractual arrangements have been determined, the terms of the contracts are negotiated between the upstream supplier and the downstream firm(s). The distribution of bargaining power during the contract terms negotiations is the main driving force of the monopolist's choices. A powerful supplier always opts for an exclusive contract. By contrast, a weaker supplier offers non exclusive contracts and makes each of them contingent or non-contingent such as to guarantee the most favorable outside option in its negotiations.
