HUKUK KÜLTÜRÜ SUÇ VE KENTSEL YAĞMA
Kültür bir toplumun duyuş, düşünüş ve davranış biçimlerinin toplamıdır. Din, aile, sanat gibi sosyal kurumlar kültürü oluşturduğu gibi, aslında kültürden de etkilenir. Bu durum hukuk içinde geçerlidir. Bir toplumun hukuka olan inancı, hukuk devletine gösterdiği saygı, o toplumun kültürünün bir yansımasıdır.

... [Show full abstract] kültürünün çok da geliştiğini söylemek zordur. Sivil toplum geleneğinin olmayışı, siyasal popülizm ve patronaj ilişkilere dayalı siyaset yapma biçimi hem toplumda hukuk devletine olan inancın azalmasına hem de hukuk dışı eylemlerin yaygınlaşmasına neden olmaktadır.
Bildiri kapsamında öncelikle hukuk kültürü ve hukuk devleti kavramları açıklanacak, Türk toplumunda hukuk kültürünü belirleyen dinamikler ele alınacaktır. İkinci bölümde, ülkemizdeki hukuk devletine yönelik ihlallere yer verilecektir. Son bölümde bu hukuk ihlallerinin toplum bakımından doğurduğu olumsuz sonuçlar üzerinde durulacaktır. Bildirinin amacı Türk toplumunun kültürel dinamikleri içinde şekillenen hukuk kültüründen hareketle ülkemizde yaşanan hukuk ihlallerini analiz etmektir.
LAW CULTURE, CRIME AND URBAN PLUNDERING
Culture is the accumulation of the perception, thinking and behavior patterns of a society. Social institutions such as religion, family and art do not only constitute the culture, but also are influenced by the culture. This is true for law too. Faith in justice system and respect to the rule of law in a society are the reflections of the culture of that society.
It is difficult to say that Turkey has an advanced law culture within state or society. Lack of the tradition of civil society, political populism and clientelism based politics give rise to the diminishing of faith in rule of law as well as the spreading of unlawful acts in the society.
Within the context of this paper, the concepts of law culture and rule of law will be described at first, and then the dynamics that determine the law culture in Turkish society will be discussed. In the second chapter (section) of the paper, the violations of the rule of law in Turkey will be examined. In the last section, the negative impacts of the violation of law on the society will be emphasized. The objective of this paper is to analyze the violations of law in Turkey in terms of the law culture shaped within the social dynamics of the Turkish society.
