In his essay Darrin MacMahon argues that hopes for happiness in life have increased in Western societies, but that “it is by no means clear that we are happier.” He then consoles us by saying that happiness is not everything and that we should not focus too much on it. While I admire his eloquent account of the history of ideas about happiness, he has missed certain facts about happiness. Some of the conventional wisdom about happiness has been rendered obsolete by recent empirical research.

Anticipatory remedies for takings

The Supreme Court has rendered two lines of decisions about the remedies available for a violation of the Takings Clause. One line holds that courts have no authority to enter anticipatory decrees in takings cases if the claimant can obtain compensation elsewhere. The other line, which includes three of the Court’s most recent takings cases, results in the entry of an anticipatory decree about ... [Show full abstract] takings liability. This Essay argues that the second line is the correct one. Courts should be allowed to enter declaratory or other anticipatory judgments about takings liability, as long as they respect the limited nature of the right created by the Takings Clause and do not usurp the limited waivers of sovereign immunity for actions to recover compensation from the government. Anticipatory litigation should not be routine. In ordinary condemnation cases and in most regulatory takings cases that turn on the particular facts presented, the action seeking compensation should provide complete and adequate relief. But where remitting property owners to an action for compensation will result in an incomplete, impractical, or inefficient outcome, anticipatory relief about whether a taking has occurred is appropriate and should be permissible. The Essay argues that recognizing the appropriate role for anticipatory remedies under the Takings Clause would help reduce the many pitfalls of litigating takings claims, and provide more consistent and effective enforcement of this constitutional right.

The author attempted to cast into a literary form the information on the careers of the teachers and jurists which , for the most part , he collected from ... [Show full abstract] the official registers , thereby seriously impairing the value of the work as a source of reference . In this dissertation this data is systematically extracted and arranged in a tabular presentation which , it is hoped , will be the pattern for the future publication of the entire work . Moreover , the facts given by Seyhi have been collated with the other biographical works dealing with the 'Ulema , and discrepancies amongst them noted. The information thus derived has been used as the basis for an introductory essay on the 'ilmiye , in which an attempt is made to characterize this important social class in the mid-17th century.

Of the short stories of Maksim Gorky’s early period, My Fellow-Traveller (‘Moi sputnik’) is not among the best-known, especially as far as non-Soviet commentators are concerned. [Show full abstract] writing. This oversight is unfortunate. As I hope to show, ‘My Fellow-Traveller’ is a complex and compelling story, and one which fully deserves to be counted among the most important of the author’s early works. What makes the story of particular interest is its central position among a series of narratives in which Gorky grapples with the problem of self-representation. In the discussion which follows, I will treat My Fellow-Traveller as an example of a type of autobiographical writing which is quite typical of the early Gorky and which, like ‘Emel’ian Piliai’, ‘At the salt-diggings’ (‘Na soli’) and others, may be described as an action tale, in which the first-person protagonist is a fully-fledged character whose thoughts and actions stand at the very heart of the narrative. I As the title of my essay suggests, the analysis will focus on the intersection within My Fellow-Traveller of two discernible strands — a parable which has its source in the political culture of late nineteenth-century Russia, and a metaphor, which is rooted more deeply in the writer’s troubled personality.

This article aims to answer these two questions by exploring the words and actions of Confucius as ... [Show full abstract] recorded in the Analects. It is argued in this essay that Confucius demonstrated and advocated a moral and social conception of creativity that emphasises evolutionary rather than revolutionary changes. Confucius supported incremental changes that were built upon the wisdom of the past, and posited the need for everyone to engage in moral self-cultivation within a community. This article contributes towards the research on the cultural influences on creativity from a Confucian perspective.
