Die langfristige Sammlung von Biomaterialien in Biomaterialbanken für die medizinische Forschung stellt für die Patienteneinwilligung eine besondere Herausforderung dar, da hier die „rechtliche Grundlage” für die zukünftige Nutzung der Biomaterialien geschaffen wird. Spezifische Aspekte wie die Anonymisierbarkeit der Biomaterialien, die Reichweite der Einwilligung (Nutzungszweck, Nutzungsdauer, Nutzerkreis) und das Auskunftsrecht/Mitteilungspflicht werden diskutiert.

Der Deutsche Ethikrat hat in seiner letzten Stellungnahme zu diesem Thema ein 5-Säulenkonzept vorgeschlagen, um vor allem die Schranken des direkten Projektbezuges zu flexibilisieren. Dessen Umsetzung stellt eine Reihe von schwierigen Anforderungen an die jeweiligen Akteure. Hierbei spielen vor allem die Zugriffsregelung, die Sicherung eines umfassenden Datenschutzes sowie die Umsetzung der Anforderungen an die öffentliche Information eine große Rolle.

This article provides a comparison of the positions of Member States in the Mediterranean and Eastern European area, focusing especially on the existing regulatory framework on biobanks, the definition of personal and genetic data, the pseudonymization process, the processing of personal data for medical research purposes (and its impact on the right to consent of the individuals involved) and the secondary use of such data. The article concludes that effective implementation of the EU GDPR will represent a decisive catalyst for adaptive harmonization of biobanks regulation in the European framework.

In 2016, The WMA announced the Declaration of Taipei on Ethical Considerations regarding Health Databases and Biobanks in Taipei which provides special ethical guidance for health database and biobank research. This paper explores the main ethical issues arising from health databases and biobanks research, refers to the Declaration of Taipei and local regulations in Taiwan, and aims to elaborate the ethical considerations for health database and biobank research.

Many questions can be answered without the active participation of individuals, but researchers must strike a careful balance between their pursuit of health improvements for all and their obligation to maintain the privacy of individuals participating in research.

Mit der zunehmenden Bedeutung für die „personalisierte Medizin“ sind standort- und länderübergreifende Nutzungen von Proben und Daten notwendig, um Studienpopulationen von ausreichender Größe für relevante statistische Aussagen zu erhalten. Diese Entwicklung stellt an die Harmonisierung von Studiendesigns, das Qualitätsmanagement von Proben und Daten sowie an Datenschutzaspekte neue Herausforderungen, denen sich nationale, europäische und internationale Initiativen stellen.

A Solidarity-based Approach to The Governance of Research Biobanks

New opportunities for large-scale data linkage and data-mining have rendered biobanks one of the core resources of medical research in the twenty-first century. At the same time, research biobanking has been seen to pose particular ethical and legal challenges pertaining to, for example, data protection, and the minimisation of other risks for participants. These measures have in turn led to ... [Show full abstract] heavy administrative, logistical, and financial costs and attracted criticism for unduly impeding disease research. Based on a newly formulated approach to solidarity, we propose an approach to governance that recognises people's willingness to participate in a public research biobank, and poses stronger emphasis on harm mitigation. We argue that such a model avoids some of the pitfalls of previous approaches. It also allows moving beyond overly restrictive and burdensome, exclusively autonomy-based governance towards governance that is reflective of people's willingness to accept costs to assist others.

[Show full abstract] biobanks, regulators will be expected to ensure: (i) that both participation and the use of participants’ samples and data are based on free and informed consent; (ii) that the privacy, confidentiality, and fair data processing rights of participants are respected; and (iii) that the proprietary rights (if any) of participants are respected. While the scope and substance of these rights are much debated, it is broadly agreed that the adequacy of the regulatory environment will be judged by reference, so to speak, to this triple bottom line.

我國現行個人資料保護法，對醫學研究部分，僅於第6 條第一項第四款規定，公務機關或學術研究機構基於醫療、衛生或犯罪預防之目的，為統計或學術研究而有必要，且經一定程序所為蒐集、處理或利用者，得蒐集、處理或利用有關個人之醫療、基因、健康檢查之資料。此規定是否能合理規範疫學研究上有關研究對象資料之蒐集或利用？雖我國所劃分規範醫學研究領域與日本不同，無法完全對應出相同部分作比較，但醫學研究上應遵守保護個人資料自主權與尊重當事人之基本倫理原則並無二致，故本文詳細介紹與分析日本訂定「疫學研究倫理指針」之原則、定位，個人資料之取得、利用及公開及安全管理等規範，並對我國個資法及醫療法等相關法律作說明，最後提出值得省思之處。 Medical progress is based on research that ultimately must include studies involving human ... For medical research using identifiable human material or data, it is the duty of physicians who participate in medical research to protect life, health, right to self-determination, privacy, and confidentiality of personal information of research subjects. This article provides an overview of ethical principles for epidemiology research which enacted by Japan in 2008. The ethical principles set forth three important subjects, the first how to get the informed consent from potential research subject, the second is the construct, function and duty of research ethical Committee, and the third protect personal information of research subjects. In Accordance with this ethical principles, the individual research subject should be provided appropriate access to participation in research, can constitute an adequate regulatory framework for protection in epidemiology research. On the other hand, Taiwan have, in the past enacted Human Research Act, Human Biobank Management Act, Medical Care Act, in order to regulate medical research and protect research subjects. Yet the scope of the existing regulations are restricted and there is considerable confusion about how the rules would be applied, they are insufficient to personal-data protection. Therefore to study ethical principles for epidemiology about Japan, we believe that can get some available reference to engage in constructive debate on the issue about personal information protection of research subjects.
