There is no consensus among legal scholars on the meaning of judicial integrity, nor has legal scholarship yet seen a well-articulated discussion about the normative concept of judicial integrity. This book makes an analysis of the discourses on judicial integrity in judiciaries in both established and developing democracies. In the former, the rul...

Oaths play an important societal role. They are sworn by the likes of magistrates, soldiers, politicians, doctors and judges. It is telling that oaths appear in all (ancient) societies: from the Aztecs to the ancient Egyptians, and from the Persians to the Chinese dynasties. But why are oaths important? Some have high expectations about the oath,...

In 2015, the Netherlands introduced a unique disciplinary system for the more than 90,000 people working in the banking sector. Under this system, a disciplinary committee has the power to impose punishment on individuals for individual misbehaviour. The disciplinary measures—ranging from compulsory training to a three-year ban from working in the...

What is the purpose of disciplinary law? Developments in The Netherlands indicate that the goal is increasingly understood as punitive. This, however, is not the essence of disciplinary law. Its goal is not satisfaction for the complainant or public punishment, but to bring certainty in - the wider practice of - discipline, that intends to safeguar...

This chapter puts compliance into the perspective of its aim: achieving a culture of integrity. Integrity, however, is characterized by elusiveness and is difficult to operationalize. This chapter deals with two questions: What does one aim for when one aims for integrity? And how to aim for integrity? First, it explains how integrity is to be unde...

The question as to what constitutes a violation of academic integrity can be interpreted broadly or narrowly. In a broad sense, the question to be answered is, when are scientists falling short in ensuring that the honorary aspect of science remains beyond all doubt? The answer to this question is that scientific values are constantly being viola...

Law is an argumentative practice and therefore lawyers need to know how to argue.

Much effort is being made to safeguard judicial integrity – but what is it? In this article, two discourses on judicial integrity will be outlined: one in which judicial integrity is said to be at stake and one in which the emphasis lies on safeguarding judicial integrity. These discourses are by no means homogeneous. Not only are there considerabl...

From where do supra- or international public institutions acquire their legitimacy? In this article, I explore Hegel’s objective philosophy in which all public institutions are in some way an expression of his concept of autonomous personality. I will attempt to answer two questions: (1) what does this idea entail? (2) Is it possible to extend this...

However, it still functions as an important normative concept in the organization of the judiciary. In the first two parts of this article, the demise of the Rechtsstaat is outlined on both a conceptual and an historical lev...
