This coordinated project aims to study these mechanisms, which are enacted at both local nation-state and supranational levels in Europe and beyond (Mishtal, 2014), in the context of the current demographic anxieties related to fertility decline, abortion and new forms of reproduction (De Zordo, Marre & Smietana, forthcoming in 2022). More specifically, it aims to investigate, within this context, the different repro-flows (of people seeking access to reproduction-related technologies – assisted reproductive technologies (ARTs), adoption, abortion - as well as of gametes) that these mechanisms produce in three world regions strictly related to each other: Europe, North-Africa and Latin-America.
Thus, it seems urgent to ask ourselves the following, fundamental questions that we aim to respond via this project, which will give an important contribution to the international academic and political debate on reproductive justice (Luna & Luker, 2013; Ross & Solinger, 2017; Smietana, Thompson & Twine, 2018) and cross-border reproductive care (De Zordo et al. 2020a, 2020b; Hudson et al., 2016; Kroløkke, 2014a, 2014b; Marre et al., 2018; Rozée Gómez et al, 2013; Smietana, 2017):
Who has the right to make her/his own reproductive decisions, including whether to have and/or raise children, when to do so and how?; Who can easily access the reproductive technologies that she/he needs to fulfill her/his reproductive desires where she/he lives, and who has to, and can travel to seek reproductive care including cross-borders, in a fragmented legal landscape marked by more or less restrictive legislations on ARTs, abortion and adoption?; What kind of challenges and burdens do reproductive travels imply for different groups of people in a period of increasing economic precariousness, marked also by the restrictions to people’s mobility due to the current pandemic?; How do people seeking access to different kinds of reproductive technologies overcome the legal barriers they face where they live and the challenges implied by having to travel across different parts of the world, or within their own country/region of residence? And how do these repro-flows (of people as well as gametes) transform some countries into repro-hubs for ARTs, abortion and adoption in Europe, North-Africa and Latin-America?; Finally, who is (or is not) able to travel to learn about her/his biogenetic origins? Do children born after ARTs and adoptees have the right to access this information in the age of reproductive biotechnology? What are the implications for secrecy, privacy, and the right to medical information?
