The project aims at criticising the way in which we theorise about criminal law: most theories either reduce it to an under-complex status of political instrument (deterrence) or reduce theories of criminal law to moral and not political questions. The project pretends to show how this view produces too narrow critics of the political legitimacy of the criminal law, ineffective ways of thinking about institutional solutions to problems of rationality of criminal politics and a mistaken understanding of what is distinctive about criminal law in the context of the law system.
