The use of such strategic indeterminacy does not necessarily require an intention to present untrue or misleading information on the part of the party drafting the text. Arguably, it may be sufficient that this party accepts the potential consequences arising due to the use of indeterminacy. [1]
Is "strategic indeterminacy" an empirically recoverable variable in legal texts (e.g. contracts, privacy policies, terms of service)? If so, how can we account for it?
