The teaching and learning of Modern Hebrew as a second/foreign language (L2) may be considered a rare phenomenon in adult secondary education in Austria, with most Hebrew classes being offered by the Jewish communities, adult education centres (Volkshochschulen) and, at the tertiary levels, by university language centres. As with other calls for cu...

Lawyering is to a large extent languaging. Formal truth as textualised in the course of criminal trials corresponds to a certain social reality by means of language. However, language is sketchy, it is at times insufficient to express the complexity of our thoughts. For instance, optical illusions show us that our brain may process information from...

Language use of the legal system under National Socialism (henceforth NS) has been described as “vague, and at the same time flamboyant […] befitting the prophet or the stump orator than the legislator or the lawyer“ (Loewenstein 1936: 781). In legal linguistics, a distinction is made between legal and linguistic indeterminacy, whereby the former relates to unclarity as to the legal qualification of certain facts of a case, while the latter is concerned with indeterminacy resulting directly from language use (Endicott 2000) in social interaction. Research on the relationship between le...

The meaning of ethic adjectives, such as unjust, (un)reasonable, objective, malicious, and (un)true, is generally related to a socially-constructed “ethical standard or moral code” (Fjeld 2005: 164-166; Leisser 2017), which leads to issues in language interpretation. Under Austrian civil law, the rules on statutory interpretation and the body of ca...

It is doubtful whether the normative space is a participatory space. Assuming that linguistic indeterminacy plays a crucial role in the i...

Questions

Questions (4)
Question
Parties may utilize strategic indeterminacy in legal texts, such as contracts, privacy policies, or terms of service. The use of such strategic indeterminacy does not necessarily require an intention to present untrue or misleading information on the part of the party drafting the text. Arguably, it may be sufficient that this party accepts the potential consequences arising due to the use of indeterminacy. [1]
Is "strategic indeterminacy" an empirically recoverable variable in legal texts (e.g. contracts, privacy policies, terms of service)? If so, how can we account for it?
[1] Riley, Kathryn. ‘Telling More than the Truth: Implicature, Speech Acts, and Ethics in Professional Communication’. Journal of Business Ethics 12, no. 3 (1993): 179–96.
Question
Which conceptual boundaries would you consider pivotal for a theoretical understanding of the term?
Question
A question that seems obvious to some, but really is not an easy one.

International Legal Linguistics Workshop (ILLWS19) ____________________________________________________________________________________ 6th – 8th December 2019 // University of Salzburg As part of the 45th Austrian Linguistics Conference (ÖLT2019), the 2nd Legal Linguistics Workshop 2019 (ILLWS19) will take place from 6th – 8th December 2019 at the University of Salzburg. The second International Legal Linguistics Workshop (ILLWS19) will be organised by the Austrian Association for Legal Linguistics (AALL). The focus of the workshop is on legal linguistics. It will primarily address, but is not limited to, questions such as: - Which potential arenas of cooperation exist for lawyers and (corpus) linguists? - How can applied legal linguistics contribute to solving language problems in legal contexts? - How can multilingual glossaries of legal terminology be compiled systematically? In which ways could these glossaries be used by transnational law enforcement agencies across jurisdictions? - Which impact do disruptive innovations, such as automated contract analysis or legal document summarization, have on the use of language in the judicial system? - Is legal linguistics undergoing a process of professionalisation in Austria? - What are the key aspects of tertiary education in legal linguistics? - Which are the ethical challenges in legal linguistic research today? - How can cognitive and functional approaches contribute to the study of legal language? - How can a multi-layered approach to discourse analysis (DIMEAN, Spitzmüller & Warnke 2011) be related to language practices in criminal law enforcement? For a formal paper presentation of 20 minutes (plus 10 minutes discussion), or for a poster presentation, applicants are required to submit an abstract of between 200 and 300 words, including the title, theoretical background, research question(s) and methodology of their project. Please also include 4-5 keywords and a short list of key references. Applications may be in English or German. Applicants may submit two abstracts, provided one of them is co-authored. Applicants should specify the intended presentation format in their proposal (formal paper presentation or poster presentation). The abstract(s), along with full name and affiliation of the applicant, should be sent by email to daniel.leisser.oegrl@gmail.com. The deadline for all submissions of abstracts is 28th September 2019. Applicants will be notified of the committee’s decision by 30th September 2019.
