Generally, we can see that law is all rules of behavior in norms regulating orders among societies. Likewise, sharia economic law regulates policies of the community in economic activities, and the application of this rule in Indonesia can be studied through Islamic boarding schools as a place for Islamic scientific education. The condition of this Indonesian pesantren is no longer only studying classical sciences. Still, also it has developed by studying modern sciences such as studies in several Indonesian pesantren which have revitalized sharia economic law as a study, which is included in the science curriculum and equipped with institutional facilities to support learning in providing an overview of sharia economic practices. Accordingly, the program has become one of the instruments for accelerating the mega-merger of Islamic banks. This research used qualitative methods with data collection through interviews and direct observations in the field. This study found that Islamic boarding schools in Indonesia have provided Islamic economic, scientific facilities, and Islamic microfinance institutions to support learning Islamic economic law to introduce knowledge and provision of Islamic economic practices so that students could apply Islamic economic values. Meanwhile, the existing programs in Indonesian Islamic boarding schools produced reliable students in the sharia economy to support the acceleration of the Islamic Bank's mega-merger through several programs such as the study of muamalah fiqh books, in collaboration with education and training held by financial institutions owned by Islamic boarding schools as well as employment programs for alumni of pesantren and guiding Islamic banking.
Islamic banking acceleration has been the major theme discussed for years, indicating the importance of such topic to be reexamined comprehensively. This study is aimed to empirically examine several aspects and condition which may play a leading role in accelerating (preventing) the growth of Islamic bank in two countries, namely Malaysia and Indonesia. To that end, this study attempts to incorporate selected internal bank condition and macroeconomic situation in a single model to exhibit the dynamics relationship between both and the total asset of Islamic banking. In terms of methodology, this study employs the dynamic panel model that is expected to be able to address the research questions. The result of this study demonstrates that both third party fund and financing-to-deposit ratio are proven to be effective in accelerating the Islamic banking asset, as opposed by the non-performing financing ratio that has a negative impact on it. Moreover, it becomes apparent the acceleration of Islamic bank share is heavily dependent upon the real sector growth represented by GDP yet the monetary variables (interest rate and exchange rate) remains the serious problem for Islamic bank to foster the growth. This implies that the real sector is valuable contributor to the share of Islamic bank compare to monetary condition.

A contract is a written agreement between a Sharia Bank or a Sharia Business Unit and another party that contains the obligation for parties in accordance with sharia principles, this is a definition according to the Sharia Banking Law. A contract is a legal relationship between parties that creates rights and obligations that are exchanged by the parties. An agreement is an event someone promises to another person or somewhere two people promise to do something or plan. All three are equated in the concept of business law engagement. The difference between the agreement and the contract according to the science of jurisprudence, the agreement is different from the agreement according to business law, but the difference is only in the term of use. By law and sharia, the murabahah and wakalah contracts are legalized. But if the murabahah bil wakalah agreement is not clear between the two contracts which one is used, there is obscurity (gharar), the law is haraam. But if the two contracts can be clear (not gharar) and separate (which one is the right one), then a transaction with two contracts is permitted, for example murabahah bil wakalah transaction, by means of the wakalah contract, then the murabahah contract, then this contract is enforced.

The Death Assurance program (JKM) is an implementation of at-takmin at-ta'awuniy namely ta'awun in the tabarru contract. This second program is for one purpose, which is to help welfare among workers. For the Old Age Guaranteed (JHT) program, this program has concepts such as the mudharabah musytarakah contract. Inclusion wakalah in murabaha financing is an innovative banking practitioners, hybrid contract, an agreement the two parties to implement a contract that contains two or more contract. Wakalah wal Murabahah is a financing agreement of sale and purchase, the bank as the seller has set aside and delegate to the customer as a buyer to purchase their own items needed on behalf of a third party bank independently. This study aims to determine the implementation of inclusion wakalah on murabaha financing at BNI Syariah Branch Kendari and economic overview of Islam against the inclusion of such contract. This study is a qualitative research using interview, observation and documentation to collect data, and then processed and analyzed by the reduction step, presentation and conclusion. Based on the nature and purpose, this study included descriptive exploratory study. The approach used in this study is normative. Based on the results of the study found a discrepancy between the implementation of inclusion wakalah on murabaha financing at BNI Syariah Branch Kendari with a scheme provided by the bank. First, themurabaha contract which should be done after the customer as the representative of the bank buys the goods to the supplier turned out to be held in conjunction with wakalah. Second, purchasing goods over to the customer representative was not in the name but in the name of customers bank itself. Third, funding the purchase of goods that should be paid directly by the bank to the supplier turned out to be melted first by transferring to customers' accounts. In the perspective of Islamic economics, murabaha wal wakalah included in this type of merger contract are allowed, but each pillar and second terms in this contract must be fulfilled if it will be combined. However, in practice, the financing murabaha wal wakalah happened in BNI Syariah Branch Kendari has invalidated one of the pillars and the terms of the sale and purchase namely the lack of traded goods and the goods are not the full property rights berakad parties. Offers to buy this kind of forbidden because included in the category of selling goods that are not owned, sell goods that is not your own and set a profit on goods that are not yet under control. Terms in wakalah also not fulfilled because the goods to be purchased has not become the property of the bank. The bank does not have a relationship of cooperation and agreement in the purchase agreements with suppliers of goods so that the purchasing process can not be delegated to the customer. Keywords: Inclusion, wakalah, murabaha financing, and BNI Syariah Branch Kendari
