Gerade realitätsnahe Simulationen von Angriffen unter Einsatz sog. „Hackertools“ sind dabei wichtige Mittel zur Gewährleistung der Penetrationssicherheit. Der Umgang mit derlei Tools allerdings kann bereits gefährlich nah am Bereich der Strafbarkeit liegen. Was genau ist also strafbar – und wie lassen sich Strafbarkeitsrisiken minimieren?

[more] The European Convention on Human Rights and the EU Charter of Fundamental Rights provide provisions for privacy and data protection. The German constitutional court has developed a new fundamental right sui generis, providing a right for privacy and integrity of IT systems. It also focused on IT security aspects when it avoided the German implementation of the EU data retention directive recently. Security of IT systems is therefore moving towards being a direct object of protection by fundamental rights in Europe. This is going to improve the legal weight of IT security measures, which will have to be considered justified, even if they appear to be unlawful at first glance.
